Purpose and legislative effect
“This section amends the definition of “resident of the Republic.””
This section amends the definition of “resident of the Republic.” The Minister must invite nominations through the media and consult specified stakeholder groups when appointing council members. The Minister may also appoint a departmental employee as chairperson despite section 6(1)(c). This provision substitutes a new section 5 of the principal Act, headed “Term of office.” A council member serves for up to three years and may be re-appointed for further terms of up to three years. This provision amends section 6(1)(c) of the principal Act by replacing the wording to refer to an employee as defined in the Public Service Act.
