Statute overview

About this statute

This section says the Act’s objects include transferring SAX shares and interests to the State, setting SAX’s main objects and powers, allowing SAX borrowing powers, and converting South African Express into a public company with share capital. SAX may borrow, give guarantees or security, and do transactions needed for its objects, subject to the Public Finance Management Act. The Minister may request conversion of South African Express (Proprietary) Limited into a public company, and the Registrar of Companies must register it and issue an amended certificate. The conversion under section 6(1) does not change SAX’s continued existence, pre-conversion rights or liabilities, employee service terms, or its main objects and powers. The Minister may publish a notice in the Gazette to make regulations about necessary administrative or procedural matters for this Act. This section amends the Public Finance Management Act by changing Schedule 2 entries on the transfer date and conversion date.
