About this statute

The Minister must extend a collective agreement by publishing a notice in the Government Gazette, usually within 60 days of receiving the request, and within 90 days if the registrar finds the bargaining council sufficiently representative. The Minister may make regulations about procedures and criteria a bargaining council must consider when developing criteria for certain section 32 purposes. This section adds rules for renewing and extending funding agreements in a bargaining council and gives the Minister and registrar related regulatory and notice-making powers. This section defines “funding agreement” and “renewal of a funding agreement” for use in the Act. The Minister may renew a funding agreement for up to 12 months in specified circumstances, and must publish a notice for public comment and consider those comments before deciding.
