This section amends section 23 of Act 28 of 2014 to add a new subparagraph about establishing and administering insurance, medical aid/benefit, pension, provident, and benevolent schemes for legal practitioners and related persons.

Section 23 of the principal Act is hereby amended —
The Council must establish Provincial Councils and may delegate certain powers and functions to them.
3. Section 23 of the principal Act is hereby amended — (a) by the substitution of subsection (1) of the following subsection: ‘‘(1) The Council must[, subject to subsection (2) and progres- sively,] establish [a] Provincial [Council in every province of the Republic] Councils the areas of jurisdiction of which must correspond with the areas under the jurisdiction of the Divisions of the High Court of South Africa as determined by the Minister, from time to time, in terms of section 6(3) of the Superior Courts Act, 2013 (Act No. 10 of 2013), and may delegate to the Provincial Councils such powers and functions which, in the interests of the legal profession are better performed at provincial level.’’; and (b) by the deletion of subsection (2). This section amends section 33 to restrict unqualified people from doing work reserved for legal practitioners.
4. Section 33 of the principal Act is hereby amended— (a) by the substitution in subsection (1) for the words preceding paragraph (a) of the following words: ‘‘Subject to any other law, no person other than a practising legal practitioner who has been admitted and enrolled as such in terms of this Act may, in expectation of any fee, commission, gain or reward—’’; and (b) by the substitution for subsection (3) of the following subsection: ‘‘(3) No person may, in expectation of any fee, commission, gain or reward, directly or indirectly, perform any act or render any service which in terms of any other law may only be done by an advocate, attorney, conveyancer or notary, unless that person is [an] a practising advocate, attorney, conveyancer or notary, as the case may be.’’. Certain board members must stay in office for six months after Chapter 2 starts, or until replacement members are elected, whichever is later.
5. A bank holding a trust account must give the Council or the Board a signed transaction history if directed to do so.
6. 8. The National Forum must negotiate and reach agreement with the relevant law societies within 24 months of this Chapter’s commencement, and may make rules under section 109(2) and (3).

Section 109 of the principal Act is hereby amended—
The Minister must make specified regulations in the Gazette after consulting the National Forum, and the National Forum must make specified rules in the Gazette, both before Chapter 2 starts.
10.
