Statute overview
About this statute
This section substitutes a new section 45 in the Local Government: Municipal Structures Act, 1998, titled “Election of members of executive committees”. A municipal council must elect its executive committee from among its members, and the meeting for that election must be held within 14 days of the relevant trigger event. This section substitutes a new section titled “Term of office of members” into section 46 of the principal Act. Executive committee members are elected for a term that ends, subject to section 47, when the municipality changes from one listed type to another listed type. A person may not serve as mayor or deputy mayor for more than two consecutive terms in the same council, and a former mayor whose terms have expired may not immediately become deputy mayor.
