About this statute

This section amends the Merchandise Marks Act, 1941 by adding two definitions, including “protected event.” The Minister may designate an event as a protected event by notice in the Gazette, but only after investigation and consultation and if the public-interest conditions are met. While an event is protected, no person may use a trade mark in the prohibited way without the organiser’s prior authority; doing so is an offence. This section states the short title of the Act: the Merchandise Marks Amendment Act, 2002.
