( I ) This Act must be interpreted in a manner that is consistent with the objectives - . - of this Act. (2) In the event of any conflict arising between this Act and any other law other than 40 the Constitution, this Act must prevail. 49. The head of the national deprtment must, with the concurrence of the heads of the provincial departments, designate health establishments which may admit, care for, treat and provide reE,abilitation services to mentally ill prisoners. IS Enquiry into mental health status of prisoner 50. (1) If it nppears to the head of a prison through personal observation or from infolmation provided that a prisoner may be mentally ill, the head of the prison must cause the mental health status (a) a psychiatrist; or ( h ) whert: a psychiatrist is not readily available, by---- of the prisoner to be enquired into by-- 20 (i) a medical practitioner; and (ii) a mental health care practitioner. (2) The persun conducting the enquiry must mbmit a written report to the head of the 25 prison, and must specify in the report- (u) the mcntal health status of the prisoner; and ( h ) a plan for the care, treatment and rehabilitation of that-prisoner. 51. If the penon conducting the enquiry referred to in section SO, finds that the mental 30 illness of the convicted prisoner is of such a nature that the prisoner concerned could appropriately be cnred for, treated and rehabilitated in the prison, the head of the prison must take the necessary steps to ensure that the required levels of care, treatment and rrjhabilitation services are provided t o that prisoner. Rfagisterial enquiry concerning transfer to designated health establishments 35 52: (1) If the person conducting the enquiry referred to in section 50, finds that the mental illness of the convicted prisoner is of snch a nature that the prisoner concerned ought to be cared for and treated in a health establishment designated in ternls of section .19, the head of the prison must request a magistrate to cause a subsequent enquiry to be conducted into the mental health status ofthe prisoner as to whether a transfer to a hcalth 40 establishment dsignated in terms of section 49 would be appropriate. (3) If the mental health care practitioners recommend that- ( a ) the prisoner should be cared for, treated and rehabilitated at a health establishment designated in t e r m of section 49, the magistrate must issue a written order to the head of the prison to transfer the prisoner concerned to that health establishment according to the procedure set out in section 54; or in a health establishment ( 0 ) the prisoner need not be cared for and treated 5 designated in terms of section 49, but instead be cared for and treated in the prison in which the convicted prisoner is in custody, the magistrate must issue 10 a written order to the head of the prison to take the necessary steps to ensure that the required to the prisoner levels of care and treatment are provided concerned. Procedure to transfer mentally ill prisoners to designated health establishments 53. (1) On receipt of a written order referred to in section 52(3)(n), the head of the 15 prison concernt:d must forward a copy of the order to- (a) the administrator, if appointed; and ( h ) the head of the national department, together with a request that the mcntally tenns of to a health establishment dcsignated in ill prisoner be transferred section 49. 20 (2) The head of the national department must immediately--- ( a ) determine the health establishment to which the mentally ill prisoner must be transferred; (h) ensure that arrangzmcn(s are made to efi'ect the transfer of :he mentally ill prisoner to the appropriate health establishment designated i n terms of section 25 49; and in writing, notify the head of the prison and the administrator, if appointed, of thehctails of such transfer. (c) (3) The head of the prison must, within 14 days of receipt of the notice of the details of the transfer, 8cause the mentally ill prisonerto be transferred to the specified health 30 establishment. (4) Whenever a transfer is eft-ectcd in terms of this section, the head of the health establishment receiving a menially ill prisoner is- (u) deemed to have lawful custody of the prisoner only on admission; and (h) resl~onsible custody of the prisoner. safe for the 35 Transfer of mentally ill prisoners between designated health establishments 54. (1) The head of the national department may from time to time order the transfer o f a mentally ill prisoner from one health establishment designatcd in terms of section 49 to a.r?o!ber if it is necessaq for the care, treatment and rehabilitation of the mentally ill prisoner. 40 (2) Despite the determination of the national department in terms of section 53(2), the relevant Review Board may only ordcr the transfer of a mentally ill prisoner to another health establishment designated fxilities- in terms of section 49 with maximum security .- is.detained. (6) Whenever a transfer is effected in terms of this section- 5 ( a ) the pxson or b6dy ordering the transfer must, in writing within 14 days ofthe transfer. notify the head of the prison where the pl-isoner is detained of the dztails of the transfer; and (b) the head of the heaith establishment receiving thementally ill prisoner- 1 0 (i) (ii) is regarded as having lawful custody of the prisoner concerned only upon r-cceiving the prisoner; and is thereafter responsible for the safe custody of the prisoner. Periodic reviews of mental health status of mentally ill prisoners 55. (1 ) The head of a health establishment in which a mentally ill prisoner is detained 15 mud canse the ITleIlkil health shdlus of that mentally ill prisoner to be reviewed every six months from thc date on which the prisoner was received in that health establishment. (2) The South African Police Service must comply with the request. (3) If the mentally ill prisoner is considered dangerous, the head of the health establishment must notify the South African Police Service. (4) A mentally ill prisoner apprehended must be held in custody for such period as prescribed to effect a return. ( 5 ) A member of the South African Police Service may use such constraining measures as apprehending a person or performing any function in terms of this section. may be necessary and proportionate in the circunlstances when Procedure on expiry of term of imprisonment of mentally ill prisoner 58. (1) A mentally ill prisoner must, subject to subsections (2) and (3), be released from prison or a health establishment designated in terms of section 49 at which the prisoner is detained on expiry of the term of imprisonment to which that prisoner was sentenced. (I) A Master of a High Court may appoint an administrator to care for ind 30 administer the property of a nlentally ill person or person with severe intellectual disability on consideration and processing of- or profound (u) a n application submitted in terms of section 60; or (b) a n order made by a High Court after an appeal or an enquiry referred to in section 60 or 61, respectively, stating that such person managing his or her properly and that an administrator be appointed. (2) An administrator may only be appointed in respect of the property of a mentally ill person or pcrson with severe or profound intellectual disability if the proccdures set out in section4 60 or 61 have been complied with. . is incapable of 35 Application to Master of High Court for appointment of administrator '10 I 60. ( 2 ) The applicaticjn must he made in writing. ~mder oath or solemn nftirmation and must- 45 (0, be[ out the reiariunship of the icpplic.,lnt to that person and-- (i) . f rhc applicant is not a spouse or nzxt of kin of that person, thc ~ c n v m ~ ~ v h y the spouse oI next of kin did not make the application; ar1d (ii) if they are not available to make the application, what steps were taken to establish their whereabouts before making the application; include all available mental health related medical certificates or reports relevant to the mental health status ofthat person and t o his or her incapability to m,mage his or her property; set out the grounds on which the applicant bclievcg that such person incapable of managing his or hcr property; state that, within seven days immediately before submitting the application, the applicant had seen that person; state the particulxs of that person and his or her estimated property value and 10 annual income; and give the particulars and contact details of persons who may provide further information relating to the mental health status of that person. is 5 (3) The applicmt must attach proof that a copy of the application has been submitted to the mentally ill person. (4) The Master of the High Court may, after considering the applicationr (a) appoint an interim administrator pending the outcome of the investigation refemd to subsection ( 5 ) ; or ( h ) appoint an administrator without conducting such investigation, if- (i) the estimated property value and annual income of that person i s below the prescribed amount; and (ii) satisfied that sufficicnt good grounds exist to make the appointment. ( 5 ) The Master of the High Court must, within 30 days of receipt of the application, cause an investigation into rhe merits of the application to be conducted by a suitably qualified person, if-- (a) certain allegations in the application require confirmation; (0) further information is required to support the application; or (c) the estimated property valae and annnal income of that person is above the prescribed amount. (6) The person conducting the investigation- ( u ) must confirm all allegations and facts contained in the application and call on that person or his or her legal-representative to respond to the application; (h) may-- (i) sumnmn any person to appear befwe him o r her to providc information ,and documents relevant to the application; and (ii) tenquire into the financial position of that person: and (c) must submit a report on his or her finding to the 3Llaster of'the High Court. (7) The investigation must be finalised within 60 days of being instituted or such extended periods as may be granted by the Master. (3) The hlasl.er must, within 14 days after considering the report-- ( a ) appoint an administrator: (0) decline to appoint an administrator; or (c) reier the matter for consideration by a Iiigh Court Judge in chambers. ( I ) Jf a High Court, when conducting an enquiry in terms of this Act or during any legal proceeding, has reason to believe that a person in respect of whom an enquiry or legal proceeding is held or conducted may be incqahle of managing his or her property, 30 the High Cout-t may. as p o f that enquiry or proceeding, initiate an investigation into the mental health status of that person and his 01- her capacity to manage h i s or her property. t (2) The High Court may, when conducting such investigati0n;request for further information f r - o m any relzvant person as may be necessary for purposes of establishing 35 the mental healh status of the person concerned and the capacity of that person to manage his o r hcr property. (3) If on completion of the investigation, the High Court finds that the mental health status of the person concerned is of such-a nature that such person is incapable of ~nanaging Ilia or her property, the High Court may- 40 ( a ) rccornrnend that an administrator be appointed in respect of that person; and (bj in writing, notify that person and a Master o f a High Court of the finding and recomrnzndation and the reasons thereof. Every organ of State responsible for health services must determine and cn-ordinate the imDlementation of its uolicies and measures in a manncr that--- of mental health care, treatment and rchabilitation ensures the provision services at primary, secondary and tertiary levels and health establishments refe'Tcd to in section 5( 1); prolnotes the provision of community-based care, treatment and rehabilitation services; prornotes the rights and interests o f mental health care users; and promotes and improves the mental health status of the population. 20 25 Designation of health establishments administered under the auspices of State as psychiatric hospitals or as care and rehabilitation centres 5. (1) The head of the national department must, nith the concumnce o f thc head of the relehant provincial department within 120 days of the commencement o f this Act, 30 designate heaitin establishments or part o f a heairh establishment which must serve as- (a) psychiatric hospitals; or (b) care and rehabilitation centres. (2) A dcsigmtion referred to in subsection ( 1) m a y at any time be revoked or varied by the head o f the national department with the concurrence of the head of the relevant 35 provincial department. (3) The head of the national department must, with the concurrence of the heads of the - 5 relevant pro\:incial departments in respect of health establishments designated in tenns of section 5( 1 j, determine the nature of the care, treatment and rehabilitation services to be provided at every establishment so designated. (4) A hcs!th chtahlishment providing inpatient secondary level care and treatment may not admit a mental health care user for more than two months unless authorised by 10 a mental health care practitioner in charge of that part of the health establishment. (5) Tertiary level nlental health care, treatment and rehabilitation services may be provided at a tertiary health establishment or a psychiatric hospital designated in terms of section 5( I) ( 6 ) Psychiatric hospitals may admit, care for, treat and rehabilitate- wluntary mental health care users in special programmes; assist-ed mental health care users; involuntary mental health care users; State patients; mentally ill prisoners; persons referred by court for psychiatric observation in terms of the Criminal Proct:dure Act; and persons admitted rehabllitation. for a long period as part of their care, treatment and (7) Care and rehabilitation centres may- 15 20 25 ( a ) conduct assessments of intellectual abilities; and ( h j provide care, treatment and rehabilitation services to persons with severe or profound intellectual disabilities, including assisted and involuntary mental hralth care users. (1) A health care provider or a health establishment may provide care, treatment and rehabilitation services to or admit a mental health care user only if-- the user has consented to the care, treatment and rehabilitation services or to admission; authorised by a court order or a Review Board; or due: to mental illness, any delay in providing care, treatment and rchahilitation services or admission may result in the- (i) death or irreversible harm to the health (ii) user inflicting serious harm to himself or herself or others; or (iii) user causing serious damage to or loss of property belonging to him or of the user; her or others. 14. Subject to conditions applicable to providing tal-e, treatment and rehabilitation services in health establishments, the head of a health establishment may limit intimate 20 relationships of adult mental health care users only if duc to mental illness, the ability o f the user to consent i s diminished. (1) A member of the Review Board may at any time be removed from office by the relevant member of the Executive Council on account of- (a) ceasing to practise the profession in terms of which he or she was appointed; (0) effectively; duties (c) absence from two consecutive meetings of the Review Board without prior inak'ility to perform his or her 5 pennission, except on good cause shown; (ct) ceasing to be a South African citizen; or ( e ) public interest. (2) A member may not be removed from office except after an enquiry. . 1 0 Vacancies 22. (1) A vacancy in the Review Board occurs-if a member of the Review Board- (a) upon at least one month's written notice tendcrs his or her resignation to the relewnt member of the Executive Council; or (0) is removed from office i n terms of section 21; ( c ) dies or becomes incapable of doing his or her work for a consecutive period of 15 six months. (2) When a vacancy in the Review Board has arisen as referred to in subsection (I) for. appointing members of the Review Board, the procedure refen-ed to in section 20(3) applies. 20 (3) A decision takcn by the Review Board is not invalid only by reason of a casual vacancy in the Review Board when such decision was taken, . . Remuneration 23. (1) The relevant member of the Executive Council may with the concurrence o f the member of the Executive Council responsible for finance determine the remunera- 25 tion, travelling expenses, subsistence allowance and other allowances to be paid to the member of the Review Board who is not in the full-time employment of the State. (2) The rtmuneration, and other allowances rcl'erred to in subsection ( I ) pust be appropriated out of the monies of the reicvant Provincial iegislature. travelling expenses, subsistence allowances Procedures of Review Board 24. (1) A Review Board may detzrmine its own procedures for conducting business. (2) (a) The relevant member of the Executive Council must designate one of the members of the Review Board as chairperson to preside at the meetings of the Review Hoxd. (h) Members of !hc Review Board may determine the procedure for appointing an acting chairperson if the chairperson is not able to preside over a meeting of the Review Board. (3) Whenever a Review Board is considering a matter that involves a health 3 0 35 establishment at which one of the members of the Rcview Board is a mental health care 40 practitioner, that practitioner may not be involved i n the consideration of the matter. 26. Subject to section 9(l)(c), a mental health care user nlay not be provided with as an rehabilitation services at a health establishment his or her consent, unless- assisted care, treatment and without outpatient or inpatient (a) a written application for care, treatment and rehabilitation services is made to the head of the health establishment concerned and he or she approves it; and jbj at the time o f making the application-- (i) there is a reasonable belief that the mental health care user is suffering from a mental illness requires care, treatment and rehabilitation services for his or her health or safety, or for the health and safety of other people; and or severe or profound mental disability, and 10 (ii) the mental health care user is incapable of making an informed decision on the need for the care, treatment and rehabilitation services. Application for assisted care, trcatrnent and rehabilitation services 15 27. (1) ( u ) A n application referred t o in section 26 may only be made by the spouse, next of kin, partner, associate, parent or guardian of a lnental health care user, but where the- (i) . user 15 below the age of 1 X years on the date of'the application, the application must be made by the parent or guardian of the user; or (ii) spowje, next of kin, partner, associate, parent or guardian of the user is or not available to rnake such an application? the unwilling, incapable application may be made by a health care provider. ( b ) The appl [cants referred to in pxagraph (u) must have seen the mental health care before user within seven days making the application. (2) Such application must be made in the prescribed manner, and must- (a) set out the relationship o f the applicant to the mental health care user; (h) if the applicant is a health care provider, ctate-- 20 25 the reasons why he or she is making the application; and (i) (ii) what steps were taken to locate the relarives of the user in order to 30 (Jetennine their capability or availability tu make the application; ( c ) set out grounds on which- the applicant believes that care, trentmcnt and rehahilitation services arc required; and ((I) state the date, time and place where the user was last seen by the applicant before within sevcn days the application is made. 35 (3) An application referrcd to in subsection ( 1 ) may be withdrawn at any time. (4) (a) On 1-c:ceipt of the application, the head of a health establishment concerned lI1ust cause the ~ n e n h health care user t o be examined by two mental health care practitioners. ( 6 ) ( a ) If the findings of the two mental health care practitioners differ, the head of the health establishment concerned must cause the mental health care user to be examined by another mertal health care practitioner. (b) That mental health care practitioner must, on completion of such examination, in 10 writing, submit a report on the aspects referred to in subsection (5). (7) The head of the health establishment may only approve the application if the findings of two of the mental health care practitioners referred to in subsection (4) or (6) concur that conditions for assisted care, treatment and rehabilitation exist. (8) The head of the health establishment may only approve assisted care, treatment 15 and rehahilitation of a prospective user as an inpatient if- (a) the findings of two mental health care practitioners concur that conditions for inpatient care, treatment and rehabilitation exist; and (0) satisfied that the restrictions and intrusions on the rights of the mental health care I.lser to movement, privacy and dignity are proportionate treatment and rehabilitation services required. to the care, 20 (9) If satisfied, the head of the health establishment must give written notice to the applicant of his or her decision concerning assisted care, treatment and rehabilitation in question and reasons thereof. (10) If the h m i of the health establishment approves the application for inpatient 25 assisted care, treatment and rehabilitation services, he or she must, within five days, cause the menta! health care user to be admitted to that health establishment or to be referred to snother health establishment with appropriate facilities. Initial review of assisted mental health care user by Review Board 28. ( I ) The head of the health establishment concerned must, within seven days of his 30 or her decision made under section 27(9), send a copy of the application to the relevant Review Board together with a confirmation of his or her decision. (2) Within 39 days of receipt of the documents referred to in subsection ( I ) , the Re\ icw Board lnust conduct an investigation into the- (a) incapacity of the mental health care user to make an informed decision on the 35 need for the assisted care, treatment and rehabilitation services; and (0) circumstances under which the mental health care user is receiving care, treatment and rehabilitation services. (3) On completion of the investigation, the Review Ro&d must- ( u ) request the head (i) continue providing the mental heaith care user with the appropriate care, of the health establishment to- 40 -- treatment and rehabilitation services; or (ii) discharge the mental health care user according to accepted clinical practice; and (bj report. on its findings and the steps taken to the head of the relevant provincial 45 department. 30 GOVERNMENT No. 24024 GAZETTE, 6 NOVEMBER 2002 Act No. 17, 2002 MENTAL HEALTH CARE ACT, 2002 (4) If at any stage before the completion of the investigation, an appeal is lodged in terms of section 29, the Review Board must stop the investigation and consider the appeal in question. rehabilitation and treatment care, Appeal against decision of head of health establishment to approve application for assisted 5 29. (1) (a) A mental health care user, spouse, next of kin, partner, associate, parent or guardian may, within 30 days of the date o f the written notice issued in terms of section 27(9), appeal against the decision of the head of the health establishment to the Review Board. (b) Such an appeal must contain the facts and the grounds upon which the appeal is 10 based. (2) Within 30 days after receipt of the appeal, the Review Board must- (a) consider the appeal in the prescribed manner; (13) provide the appellant, applicant, the relevant mental health care practitioners and t.he head of the health establishment concerned an opportunity to make 15 oral ‘or written representations on the merits of the appeal; and (c) send a written notice of its decision togetherwith reasons for such decision t o the appellant, applicant, head of the health establishment in question and the relevant mental health care practitioner. (3) If the Review Board upholds an appeal, all care, treatment and rehabilitation 20 services administered to a mental health care user mustbe stopped according to accepted by the health clinical practi1:es and the user, if admitted, must be discharged establishment, unless the user consents to the care, treatment and rehabilitation services. Periodic review and annual reports on assisted health care users 30. (1) Six months after the commencement of care, treatment and rehabilitation 25 services, and every 12 months thereafter, the head of thc health establishment concerned must cause the mental health status of an assisted mental health care user to be reviewed. ( 2 ) such’ review must- ( a ) state the capacity of the mental health care user to express himself or herself . on the need for care, treatment and rehabilitation services: (6) state whethcr there are other care, treatment and rehabilitation services that are less reatrictive or intrusive on the right to movement, privacy and dignity of the user; and (c) make. recommendations regarding a plan for further care, treatnknt and services. rehabilitation (3) A summary report of the review must be subrnittcd to thc Review Hoard. (4) Within 30 days after receipt o f the report, the Review Board- (a) may consult with any person who may have information concerning the me11id heakh siatus of the user;- on the review; and decide (b) must ( c ) must send a written notice of its decision and the reasons there,of to the mental head of the health the head of the relevant health care user in question, applicant concerned, establishment where the user is admitted and provincial department. .3 0 35 -10 (5) (a) If the Review Board concerned decides to discharge the assisted mental health 45 care user-

Recovery of capacity of assisted mental health care users to make informed decisions 31. (1) If the head of a health establishment, at any stage after approving an 10 application €or assisted care, treatment and rehabilitation services, has reason to believe from personal observation, from information obtained or on receipt of representations by the user that an assisted mental health care user has recovered the capacity to make informed decisions, he or she must enquire from the user whether the user is willing to voluntarily con time with care, treatment and rehabilitation services. (2) If the assisted mental health care user consents to further care, treatment and 15 rehabilitation services, section 2.5 applies. - (3) If the assisted mental health care user is unwilling to continue with care, treatment and rehabilitation services, and the head of the health establishment is satisfied that the user is- 20 no longer suffering from the mental illness or mental disability referred to in secticn 26(6), the head of the health establishment concerned must immedi- ately cause the user to be discharged according to accepted clinical practices; or still suffcring from the mcntai illness or mental disability referred to in section 25 26(b), the head of the health establishment Concerned must, in writing, inform t h - (i) person who made the application in terms of section 27; and (ii) Inental health care practitioner, registered social worker or nurse to that mental 30 administering care, treatment and rehabilitation services health care user. A mental health care user mist be provided with care, treatment arid rehabilitation services withow his or her consent at a health establishment on an outpatient or inpatient 40 basis if- (a) an application in writing is made to the head of the health establishment concerned to obtain the necessary care, treatment and rehabilitation services and the application is granted; (0) at the tinle of making the application, there is reasonable belief that the n~cntal 4.5 health, La[-e user has ;f mental illness of such a nature that- 34 _ _ _ _ _ _ _ _ GAZETTE, GOVERNMENT No. 24024 6 NOVEMBER 2002 Act No. 17,2002 MENTAL HEALTH CARE ACT, 2002 the user is likely to inflict serious harm to himself or herself or others; or (i) (ii) care, treatment and rehabilitation of the user is necessary for the protection of the financial interests or reputation of the user; and (c) at the time of the application the mental health care user is incapable of making an informed decision on the need for the care, treatment and rehabilitation services and rehabilitation required. is unwilling to receive the care, treatment and 5 Application t o obtain involuntary care, treatment and rehabilitation 33. (1) ( a ) A.n application for involuntary care, treatment and rehabilitation services may only be made by the spouse, next of kin, partner, associate, parent or guardian of a 10 mental health care user, but where the- (i) user is below the age of 18 years on the date of the application, the application must be made by the parent or guardian of the user; or (ii) spouse, next of kin, partner, associate, parent or guardian of the user is unwilling, incapable application may be made by a health care provider. or is not available to make such application, the 15 (0) The applicants referred to in paragraph (a) must have seen the mental health care user within seven days before making the application. (2) Such application must be made in the prescribed manner, and must- (a) set out the relationship of the applicant to the mental health care user; (17) if the applicant is a health care provider, state- (i) (ii) what steps were taken to locate the relatives of the user to determine their the reasons why the application is made by him or her; and 20 capability or availability to make the application; (c) sct out grounds on which the applicant believes that care, treatment and 25 rehabilitation are required; and (d) state the date, time and place where the user was last seen by the applicant within seven days before making the application. (3) An application referred to in subsection (1) may be withdrawn at any time. (4) (aj O n receipt of the application, the head of the health establishment concerned 30 must cause the mental health care user to be examined by two mental health care practitioners. ( h ) Such mental heaith care practitioners must the application and at least one of them must be qualified to conduct physical examinations. not be the person making ( 5 ) On completion of the examination the mental health care practitioners must 35 submit to the head of the health establishment their written findings on whether the- (a) circumstances referred to in section 32(h) and (c) are applicable; and (0) mental health care user must receive involuntary care, treatment and rehabilitation services. (6) (0) if the findings of the two mental health care practitioners differ, the head of the 40 1:dth egab!ishment concerned must cause the mental health care user to be examined by another mental health care practit' loner. (6) That mental health care practitioner must, on completion of such examination submit a uritten report on the aspects referred to in subsection (5). 36 No. 24024 GAZETTE, GOVERNMENT 6 NOVEhfBER 2002 Act No. 17,2002 MENTAL IIEAlFII CARE .4CT, 2002 - (7) The head of :he health establishment may only approve the application if the findings of two of the mental health care practitioners referred to in subsection (4) or (6) concur that conditions for involuntary care, treatment and rehabilitation exist. (8) The head of the health establishment must, in writing, inform the applicant and care, treatment and rehahilitation give reasons o n whether to provide involuntary services. (9) If the head of the health establishnlent approves involuntary care, treatment and rehabilitation services, he or she must- (a) within 48 hours cause the mental health care user to be admitted to that health establishment; or (b) with the concurrence of the head of any other health establishment with the appropriate facilities, refer the user to that health establishment. 5 10 72-Hour assessment and subsequent provision treatment and rehabilitation of further involuntary care, 34. (1) If the head of the health establishment grants the application for involuntary 15 care, treatment and rehabilitation services, he or she must- (a) ensure that the user is given appropriate care, treatrncnt and rchabilitation servi'xs; ( b ) admit the user and request a medical practitioner and another mental health care practitioner to assess the physical and mental health status of the user for 70 a period o f 72 hours in the manner prescribed; and (c) ensure that the practitioners also consider whetha- (i) the involuntary care, treatment and rehabilitation services must be continued; and (ii) such care, treatment and rehabilitation services must be provided o n an 25 outpatient or inpatient basis. (2) The head of the health establishment must, within 24 hours after the expiry of the to the findings of the assessmeut period make available the 72-hour assessment applicant. (4) If the ~ncntal hcalth carc user is to be cared for, treated and rehabilitated on an inpatient basis and the user has been admitted to a health establishment which is- (.) a psychiatric hospital, that hospital must keep, care for, treat and rehabilitate the ucer; or 5 (b) not L psychiatric hospital, that user must be transferred to a psychiatric hospital for care, treatment and rehabilitation services, until the Revie,, Hoard makes its decision. (5) If at any time after the expiry of the 72-hour assessment period, the head of the 10 health establishmcnt is of the opinion that the user who was admitted on an involuntary inpatient basis is fit to be an outpatient, he or she must- (u) discharge the user according to the prescribed conditions or procedures: and (h) inform the Keview Board in writing. (6) l h e head of the health establishment may cancel the discharge and request the user 15 to retun1 to the health establishment on an involuntary inpatient basis, if he or she has reason to believe that the user fails to co~nply with the terms and conditions of such discharge. (7j The Revlew Board must, within 30 days of receipt of documents referred to in subsection (3)(c)(i)- 20 ( a ) consider the request in the prescribed manner, and give the applicant, mental hcaltll care practitioners referred to in section 33 or an independent mental health care practitioner? if any, and the head of the health establish~nent an opportunity to make oral or written representations on the merits of the requt:st; ( b ) send a decision in writing with reasons to the applicant and the head of the ( c ) hea!th establishment; and if the Review Board decides to grant the request, submit to the Registrar of a High Court the documents referred to i n subsection (3)(c)(i) and the written notice for consideration by a High Court. 25 30 (8) fat a n y :;tage before nuking a decision on further involuntary care, treatment and rehabilit:1tion services on a11 inpatient basis, an appeal is lodged against the decision of the head o f the 11e;tlth cstablishrnent in terms ol'section 35, the Review Board must stop the review proceedings and consider the appeal. (3) If the Review Board upholds the appeal--- or oral (a) all care, treatment and rehabilitation services administered to the mental health care user must be stopped according to accepted clinical practices; and the head of the health establ Ishnlent, unless the user consents to the care, treatment and rehabilita- tion services. 36. Within 30 days after receipt of the documents submitted by the Review Board in tcrms of section 34(7) or 35(4), the High Corn- (a) must Iconsider information submitted and any other representations made by 20 any pcrson referred to in section 3S(1); (b) may obtain information from any relevant person; and ( c ) must thereafter order- (i) further hospitalisation o f the mental health care user and, if necessary, the tixmcial ailairs uf the mental health care user be managed and administered according to the provisions of Chapter VIII; or immediate discharge of the mental health care user. (ii) 2s Periodic review and annual reports on involuntary mental health care users 37. ( I ) Six Inonths after the commencement of care, treatment and rehabilitation services, and every 12 months thereafter, the head of the health establishment concerned must cause the rncntal health status of a n involuntary mental health care user lo be reviewed. 30 (2) Such review must- state ,.he capacity of the mental health care user to express himself or herself on the need for care, treatment and rehabilitation services; state whether the mental health care user is likely to inflict serious harm on himself or herself or other people; statc whether there is other care, treatment and rehabilitation services that are x the right of the mental heal1.h care user to less rcstrict1.ve or i ~ t r ~ s : ~ movcment, privacy and dignity; and make recommendations rcgarding a rehabilitation service. plan for further care, treatment or . . (2) I f the involuntary mental health care user consents to further care, treatment and rehabilitation services, section 25 applies. (2) 'l'he head o f the health establishment must submit a copy of the report to the applicant to enable the applicant to suhmit representations to the Review Board on the merits of the trxlsfer. 40 !3) The Review Board must not approve the request- ( a ) in order to punish the mcntrtl health care user concerned; or (0) if not satisfied that the mental health status of the user warrants a transfer to. maximum security facilities. 'Intervention by members of South African Police Service 40. (1) If a mcmber of the South African Police Service has reason to believe, from or from iuformation obtained personal observation practitioner, that a person due to his or her mental illness or severe or profound intellectual disability is likely to inflict serious harm to himself or herself or others. the member must apprehend the person and cause that person to be- from a mental health care ( a ) taken to an appropriate health establishment administered under the auspices of the State for assessment of the mental health status of that person; and (b) handed over into custody of the head of the health establishment or any other person designated by the head or the health establishment to receive such persocs. (2) If a mental health care practitioner, after the assessment referred to in subsection (1); is of the view that the person apprehended is- ( u ) due to lnental illness or sevcre or profound intellectual disability, likcly to inflict serious harm to himself or herself or others, must admit the person to the health establishment for a period not exceeding 24 hours for an application to be made i n terms of section 33; or j 10 - 15 20 ( h ) unlikely t o cause harm, he or she must release the person immediately. 25 ( 3 ) If an application is not made within the 24 hour pcriod, the person apprehended must be discharged immediately. (4) If an assisted or involuntary mental health care user has absconded or is deemed 27(10), 33(9), to have absconded or if the user has to be transferred under scctions 34(4)(0), 34(6) and 39, the head of the health establishment may request assistance from 30 the South African Police Service to- ( u ) locate, ak?-prehend and return the user to the health establishment concemed; or (0) transfer the user in the prescribed manner. (5) The South African Police Service must comply with the request. (6) When requesting the assistance, the South African Police Service must be 35 informed of the ehtimated level of dangeroasness of the assisted or involuntary mental hc:rlth care user. (7) Aperson apprehended in terms of subsection (4) may be held in custody at a police station for such period as prescribed to effect the return or the transfer in the prescribed mlanncr. (X) A member of the South African Police Service, may use such constraining ir, the circumst::r,ces when rne:isu!-es as may be xcessary and proportionate qpl-chending a pcrxon or performing any function in ternls'of this section. 40 CHAPTER VI STATE PATIENTS 4s Designation of health establishments for State patients

( I ) Where a court issues an order in terms of the Criminal-Procedure Act for a State patient to be admitted for menta! health care, treatment and rehabilitation services, the Registrar or the Clerk of the court must send a copy of that order to the-- ( a ) relevant oflicial cumtor ad litern; and jbj ofticer i n charge of the detention centre where the State patient is or will be 5 detained. (2) The officer i n charge of the detention centre nus st forward a copy of the order in question to the head of the national department within 14 days, requesting that the State patient be transfixred to a health establishment designated in terms of section 41. ( 3 ) The head of the mtional department must immediately after receipt of the order- ( a ) determine the health estahlishrnent to which the State patient must be transferred; (b) ensure that arrangements are made to eifect the transfer of the State patient to the health establishment (c) in writing notify- designated i n terlns of section 41; and (i) the relevant official cwrator- ad litrrrz; and (ii) the official in charge of the detention centre at which the State patient is detained, of the derails of the transfer. 10 15 20 (4) Within 13 days of being notitied of the details of the transfer, the oficer in charge transfen-ed to the health cause the State patient to be of the detention centre must establishment specified in the notice. (1) If a %ate patient has absconded or is deemed by the head of the relevant designated health establishment to have absconded, the head of that health establish- ment must, in wl-iting--- ( [ l ) inmediately notify and request the South African Police Service apprehend and return the patient to the relevant health establish; and to locate, S (bj notify the Registrar or Clerk of the court concerned and the official cumfor ad litem: ,within 14 days of having notified the South African Policc Service. (2) The South African Police Service must comply with the request. (3) If a State patient is considered dangerous, the head of the health establishment 10 must notify the South African Police Service. (4) A State patient who is apprehended must be held in custody for such period as prescribed to etfixt the return. (1) Any of the following persons may apply to a judge in chambers for the discharge of a State patient: (a) The State patient; (b) an official curator ad litem; ( c ) an administrator, if appointed; (d) the head of the health establishment at which a State patient is admitted; ( e ) the medical practitioner responsible for administering care, treatment and 5 rehabilitation services to a State patient; (f) a spouse, an associate or a next of kin of a State patient; or (g) any other person authorised to act on behalf of a State patient. ( 5 ) The legal practitioner appointed iri ternx of subsection 4(b) must- (a) addu’x any available evidence relevarlt to the application; ( h ) perform the functions and duties as required by the judge in chambers conccmed to process the application; and (c) be remunerated by the national department responsible for justice and constitutional development according to the tariffs and scale of benefits and allotbances determined for this purpose by the member of Cabinet responsible for justice and constitutional development. (6) On considering the application, the judge in chambers may order that the State patient- ( a ) remain a State patient; ( 6 ) be reclassified and dealt with as a voluntary, assisted or involuntary mental heaith care user in terms of Chapter V; ( c ) be discharged unconditionally; or (d) be diwharged conditionally. (7) For the pul-poses of this section “legal practitioner” means an attorney or an advocate who has a right of appearance i n a High Court. Cond.itional dis;charge ofstate patients, amendments to conditions or revocation of conditional discharge 5 10 15 20 38. (1) When: a State patient is discharged conditionally in terms of section 47(6)(d), such an order rrtust s1xcify the terms and conditions of the discharge and the period of the conditional discharge. 25 (2) The head of !he health establishment from which the State patient was conditionally discharged must- (a) c;Iuse the mental health status of the State patient to be monitored at that health establishment; or (b) aI-range for another health establishment to monitor the State patient, if the conditional discharge requires the State patient to present him or herself at that health establishment fsr care, treatment 2nd rchabilitation services. (3) The person monitoring the State patient must submit a written report to the head of the health establishment at which the State patient was discharged- ( a ) relating to any terms and Conditions applicable to the discharge; (h) at the end of every six months frvm the date on which the conditional discharge order Uas made; and (c) at the end of the conditional discharge period. (4) If at the end of the conditional discharge, the head of the health establishment is satisfied that tke State patient applicable to (he discharge, and that the mental health status of the State patient has not deteriorated, the head of rhac heair‘n estabiishment nust-- has t‘ully complied with the terms and conditions (a) iInmec!iately discharge the State patient unconditionally; and ( b ) i n nriting, inform the State patient, the Kegislrar concerned and the official cumtot; od litem. (7) The application referred to in subsection (6), must set out the- (a) condition to be amended; ( b ) duration of such amendment; and (c) reasons for the amendment or revocation of the conditional discharge. 5 10 CHAPTER VI1 . . (1) (a) An administrator must, before a Master of a High Court signs an ()%cia1 notice Of appointment, lodge security with the relevant Master of the High Collrt of an amount to be determined by the Master. (0) The Master may, on good cause shown by the administrator- 5 (i) red.uce the amount of security required; or security. (ii) dispense with (2) If the Master at any stage- fa) becomes aware that sequestration proceedings against the administrator have 10 commenced or are likely to be instituted; or (0) has reason to believe that it is in the best interest of the person in respect of whom the administrator has been appointed, he or she may- (i) increase the amount (ii) app'uint a co-administrator, and all acts relating to the property of the person of security to be paid by that administrator, or 15 concerned must be done with the consent of both administrators. (3) An administrator has powers and functions to- (a) take: care of and administer the property of the person for whom he or she is incidental ( h ) carry on any business or undertaking of that person subject to any other law. perform and appointed all functions and thereto; (I) An administrator- (a) may not alienate or mortgage any inmovable property of the person for whom he or she is appointed unless authorised to do so by a court order or with the consent of the Mastep of the High Court; and relevant (0) his or her spouse, child, parent, partner, associate or agent may not purchase 20 25 or otherwise acquire any property of that person unless-- (i) with the consent of the relevant Master; or (ii) the purchase or acquisition was, in writing, legally authorised by before person that administrator appointed. was that 30 ( 5 ) An administrator must, immediately after his or her appointment, pay all moneys received on bellalf of the person he or she is appointed for into the hands of the relevant Master of the High Court, unless- (a) the Master directs otherwise; (0) a legal document of that person made before the administrator was appointed, 35 authorises otherwise; or (c) the money is required to-- (i) repay of any debt; (ii) pay expenses relating to the safe custody of the property of that person; (iii) maintain or educate that person or his or her dependants; (iv) p;iy for the current expenditure of' the business or undertaking of the or person. Termination (of administrator 64. (1) The term of office of an administrator appointed in terms of this Act may only terminated be made on consideration of an application by- (a) a person in respect of whom the administrator was appointed; (b) that administrator; or ( c ) the person who made an application for the appointment of the administrator concerned. (iii) 68 GAZETTE, GOVERNMENT 24024 No. 2002 6 NOVEMBER Act No. 17,2002 MENT.4L HEALTH CARE ACT, 2002 (3) The Master of the High Court must, within 14 days of receipt- of the application- ( a ) terminate the appointment of the administrator; (0) decline the application; or (c) refer the matter for the consideration by a High Court judge in chambers. (4) If the Master of the High Court terminates such appointment or declines the 5 application to terminate, he or she must, in writing, notify the applicant of the decision and reasons thereof. ( 5 ) If the Master of the High Court declines the application or refuses to refer the application for consideration by a Nigh Court Judge in chambers, the applicant may, within 30 days of receipt of the notice referred to in subsection (4), appeal against the 10 decision of the Master- ( a ) by submitting a written notice of appeal to a High Court judge in chambers; ( b ) setting out the grounds'of the appeal; and (c) submit a copy of the notice to the Master. (6) The Master of the High Court must, within 14 days after receipt of an appeal in 13 terms of subxection ( 5 ) or after referring consideration, submit to the High Court ;1 copy of- an application to a High Court for ( a ) the application; ( b ) a written summary of his or her findings; ( c ) the reasons for refusing the application or for referring the application to the 20 High Court, as the case may be; and fd) the notice of appeal, in the case of an appeal. (7) The High Court must, within 30 days of receipt ol' the relevant documents- ( a ) consider the application or appeal in the prescribed manner, as the case may be; (b) provide the- independent mental health practitioners, (i) appellant: (ii) relevant administrator; (iii) (iv) head of the health establishment, the opportunity to make oral or written representations on the merits of the application or appeal; and in writing, notify the appellant, administrator, head of the health establishment concerned and head of the relevant provincial department of his or her decision the reasons if any; and thereof. (1) The Minister may, after consultation with all relevant members of the Council. (1) A re!;ulation made under this Act may- (u) confer powers or duties on any person, body or public authority; ( h ) contain conditions and provide for exemptions; or ( c ) be i n respect of different- 40 (i) parts of the Republic; or (ii) categories of persons. (2) The Minister may, in any regulation made under this Act- ((2) designate as authoritative any published methodology, procedure, piactice or stanclard that is generally recognised as authoritative within the relevant profession: and 45 (0) require m y person or body to comply-with that designated methodology, procr:dure, practice or standard. 12 No. 24024. (1) The Minister must, before making or amending regulations under this Act--- ( u ) by notice in the Gazette, publish his or her intention to make regulations; (h) state: in the notice- that draft regulations have been developed (i) for comment; (ii) where a copy of the draft regulation may be obtained; and (c) allow at least 30 days period for comment; and (d) consider comments received. (2) At any time before issuing regulations, discussions and consultations may be held with any intersested group. (3) Subsection (1) does not apply- in respect of- (a) any regulation which the public interest requires to be made without delay; or (b) an amendment to correct a textual error. (4) Any regulation regarding State revenue or expenditure must be made with the concurrence of the Cabinet member rcsponsible for finance. 5 I O 15 ( 5 ) Any reglulation regarding the South African Police Service must be made with the concurrence of the Cabinet member rcsponsible for safety and security. (6) Any regulation regarding education must be made with the concurrence of the Cabinet member responsible for education. (7) Any regulation regarding the terms and conditio& of a person employed by the 20 national department, a provincial department or district health authority or any labour relations matter, must be made with the concurrence of the Cabinet member responsible for public service and administration. (8) Any re;gulation regarding the appointment of an administrator including the threshold amounts for the appointment of a Master of a High Court as administrator and 25 conditions for such appointment, must be made with the concurrence of the Cabinet member responsible for justice and constitutional development. Conditions and exemptions contained in regulations 69. (1) The Minister may, at any time by notice in the Gazette with regard to any person, institution. body, or organisation- ( n ) impose. \,ary or withdraw any condition in a regulation; or (b) grant, vary or withdraw an exemption in a regulation. (2) The Minister may not vary or withdraw any condition or exemption made under this Act unless a person or body alfected made representation to that elfect. CHAPTER X GENERAL PROVISIONS 30 3s Oeences and penalties 70. (1) Any person w h e ( a ) misrcpresents a fact in any application, report, record, certificatc; jb) obstructs or hinders any person in h e performance of his or her functions; (c) neglects, abuses or treats a mental health care user in any degrading manner or 40 allo~~vs the user to be treated in that manner; ( d ) assi:jts or incites a mental health care user- (i) to abscond from a healrh establishment at which he or she is admitted; or 74 No. 24024 GOVERNMENT GAZETTE, 6 NOVEMBER 2002 Act No. 17, 2002 MENTAL HEALTH CAKE ACT, 2002 (ii) not to comply with any care, treatment and rehabilitation plan or terms of a leave of absence or conditional discharge; or ( e ) refuses to furnish information or provides false information the South African Police Service about the whereabouts cas-e user who has absconded or is deemed to have absconded, to a member of of a mental health under this Act, is guilty of an offence. (2) Any person who is found guilty of an oft'ence under this Act is liable on conviction to a fine or to imprisonment for a period not exceeding six months or to both such fine and such imprisonment. Establishment of advisory or technical committees 5 10 - 71. (1) The Minister may appoint achieve the objectives of this Act. an advisory or a technical committee in order to . (2) When appointing an advisory or a technical committee, the Minister may, by regulations, determille- (a) the composition, functions, (b) the terms, conditions, remuneration and allowances applicable to members of such committee with the concurrence of the Cabinet member responsible for finance; and and working procedure of the committee; 15 (c) any other incidental matter. assignment Delegation and of powers and agreements 20 72. (1) (a) The Minister may, in writing, delegate any power conferred on him or her by this Act or any other law to any- (i) pcrson in the (ii) board or body established under this Act, employ of the State; or referred except the powers to i n section 66. (b) The relevant member of the Executive Council may. in writing, delegate any power conferred on him or her by this Act or the Minister to any person or body referred to in paragraph (a). (2) A person or body to whom any power is delegated m a y exercise that power subject 25 to the direction of the Minister or relevant member of the Executive Council. 30 (3) 'The Ministcr or relevant member of the Executive Council may, at any t:me- (a) withdraw a delegation made under subsection (b) withdraw or amend any (1); or ,decision made in the exercise of such delegated power. (4) A decision made in the exercise of any delegated power, unless withdrawn or 35 amended, is deemed to have been made by the Minister or relevant member of the Executive Council, as the case may bz. (5) Any right or privilege acquired or any obligation or liability incurred as a result of a decision made in terms of a delegated power referred to in subsection (1) cannot be affected by any subsequent withdrawal or amendment of that decision. (6) The national department or a provincial department may enter into agreement with any non-governmental organisation or public or private provider of goods or services in order to exercise powers and perform functions and duties under this Act. 40 Repeal of laws 73. (1) The laws set out in the first and second column of the Schedule are repealed 45 to the extent set out i n the third column of the Schedule. (2) The repeal does not affect any tranaitional arrangetnent contained i n section 74. 76 No. 24024 GOVERNMENT GAZETTE, 6 NOVEMBER 2002 Act h'o. 17, 2002 MENTAL HEA1,TH CARE ACT, 2002 Transitional arrangements 74. ( I ) The transitional arrangements in this section must be read and applied as substantive provisions of this Act. ( 2 ) Anything done before the commencement of this Act in terms of the laws repealed is regarded a's done under this Act and continues to be of force and effect- ( u ) except if it is inconsistent with this Act; or (h) until it is set aside or repealed. (3) Any proceedings instituted or procedures conducted under the laws repealed by this Act, must be disposed of as if this Act has not been enacted. (4) Any person who in terms of the laws repealed by this Act was considered a voluntary pal.ient, must on the commencement of this Act be dealt with in terms of section 25. ( 5 ) ( a ) Any person who in terms of the laws repealed by this Act was regarded as a patient by consent, is at the commencement of this Act deemed to be an assisted mental health care user and for purposes of section 30 must be reviewed within six months. ( [ I ) Any review clone within six months before the commencement of this Act is deemed to be a six months review in terms of section 30. (6) (a) Any person issued with a detention order in terms of the laws repealed by this Act. is on the commencement of this Act deemed to be an involuntary mental health care user and for purposes of scction 37 must be reviewed within six months. ( [ I ) Any review done within six months before the commencement of this Act is 5 10 15 20 deerned to be a six months review in terms of section 37. (7) (a) Any peison who in terms of the laws repealed by this Act, was regarded as a State patient lor mentally ill prisoner must, on the commencement of this Act, be dealt with i n terms of Chapters VI and VII, respectively, and for purposes of sections 46 and 25 55, reTpectivt:ly, be reviewed within six months. (0) Any review done within six months before the commencement of this Act i s deerned to be a six months review in terms of sections 46 and 55, respectively. (8) Any certificate issued in terms of section 43 or 44 of the laws repealed by this Act continues to be of force and effect but the duration of the certificate may not be extended 30 on its expiry. 75.
