(2) The National Licensing Officer may, in respect of a licence granted in terms of subsection (1)(a)— (a) suspend, for such period as it may determine, or cancel a licence for non-compliance with this Act or any regulations made under this Act, or with any terms, conditions or limitations attached to a licence in terms of section 3C(1)(h): Provided that the licence holder has been informed of the non-compliance and given a reasonable opportunity to rectify the non-compliance. (b) declare such licence to be subject to such conditions as contained in this Act and the regulations made under this Act, and further conditions specific to the application concerned; or (c) withdraw the suspension of such licence or of any right or privilege that is attached thereto, subject to such conditions as contained in this Act and the regulations made under this Act. The Director-General may, at the request of the National Licensing
The Director-General may appoint experts or other persons when asked by the National Licensing Officer, and the National Licensing Officer may delegate functions, but delegations must be written and must state their scope.
3D. The Director-General may, at the request of the National Licensing Officer, and subject to the laws regulating the public service, appoint such experts or other persons as may be necessary to implement this Act. 35 Delegation of powers and functions 3E. 3D. (2) An application for a licence in terms of this Act must be in writing and 5 must include the following information: (a) A detailed description of the animal that the applicant intends to exhibit or train for exhibition or use for safeguarding; (b) a detailed description of the general nature of the performances in which the animal is intended to be exhibited or trained to be exhibited; a detailed description of the general nature of the safeguarding in which the animal is intended to be used; (c) (d) a detailed description of the type of living quarters that will be provided to the animal when performing or not performing, being exhibited or trained to be exhibited or for safeguarding; (e) meal plans and general practices that the applicant will follow to (f) maintain and ensure the health and wellbeing of the animal; the number of hours per day that the animal will be required to perform, be exhibited, trained to be exhibited or safeguarded; (g) written motivation for the granting of the licence; (h) information as to whether the applicant has ever held or been refused a certificate or licence in the past; and proof of payment of the prescribed fee. (i) (3) The National Licensing Officer may, with the consent of the applicant, visit the premises under the lawful control of the applicant to assess the suitability thereof for the intended exhibition, training or safeguarding of animals. (1) The National Licensing Officer may grant an application for any 30 licence if he or she is satisfied— (a) with the information furnished by the applicant as contemplated by (b) section 3F(2); and that the premises, accommodation, equipment and facilities that are utilised for the training, exhibition or performance of the animal are safe and will not cause harm to the animal. (2) The National Licensing Officer must consider and decide on an application within 45 days after receipt of the application. Hearing of applications 3H. (1) The National Licensing Officer may make a determination whether to grant, refuse, or amend a licence on the basis of the documents submitted by the applicant. (2) If the National Licensing Officer cannot make a determination on the documents submitted by the applicant he or she may convene a hearing to consider any application on such date, time and place as determined by him or her. (3) The applicant and any interested person that the National Licensing Officer may request to be present at the hearing must be notified of the date, time and place of the hearing, in writing, at least 10 days before the date of the hearing. (2) ’n Aansoek om ’n lisensie ingevolge hierdie Wet, moet skriftelik wees 5 en moet die volgende inligting insluit: (a) (b) (c) (d) ’n Uitvoerige beskrywing van die dier wat die aansoeker voornemens is om te vertoon of af te rig vir vertoning of te gebruik vir beveiliging; ’n uitvoerige beskrywing van die algemene aard van die uitvoerings waarin die dier bestem is om vertoon te word of vir vertoning afgerig te word; ’n uitvoerige beskrywing van die algemene aard van die beveiliging waarvoor die dier bestem is om gebruik te word; ’n uitvoerige beskrywing van die tipe blyplek wat vir die dier voorsien sal word wanneer dit optree of nie optree nie, vertoon word of afgerig word om vertoon te word of vir beveiliging; (f) (e) maaltydplanne en algemene praktyke wat die aansoeker sal volg om die gesondheid en welstand van die dier te handhaaf en te verseker; die getal ure per dag wat van die dier vereis sal word om op te tree, vertoon te word, afgerig te word om vertoon te word of vir beveiliging gebruik te word; skriftelike motivering vir die toestaan van die lisensie; inligting oor hetsy die aansoeker ooit in die verlede ’n sertifikaat of lisensie gehou het of geweier is; en bewys van betaling van die voorgeskrewe gelde. (g) (h) (i) 10 15 20 25 (3) Die Nasionale Lisensiëringsbeampte kan, met die toestemming van die aansoeker, die perseel onder die wettige beheer van die aansoeker besoek om die geskiktheid daarvan vir die voorgenome vertoning, afrigting of beveiliging van diere te assesseer. Oorweging en toestaan van aansoeke om lisensies deur Nasionale Lisensiëringsbeampte 30 3G. (1) Die Nasionale Lisensiëringsbeampte kan ’n aansoek om enige lisensie toestaan indien hy of sy tevrede is— (a) met die inligting deur die aansoeker verstrek soos in artikel 3F(2) beoog; en (b) dat die perseel, akkommodasie, toerusting en fasiliteite wat vir die afrigting, vertoning of opvoering van die dier gebruik word veilig is en nie enige leed aan die dier sal veroorsaak nie. (2) Die Nasionale Lisensiëringsbeampte moet die aansoek oorweeg en daaroor besluit binne 45 dae vanaf ontvangs daarvan. Aanhoor van aansoeke 3H. (1) Die Nasionale Lisensiëringsbeampte kan ’n bepaling maak om ’n lisensie toe te staan, te weier of te wysig op grond van die dokumente wat deur die aansoeker voorgelê is. (2) Indien die Nasionale Lisensiëringsbeampte nie ’n beslissing kan maak op grond van die dokumente deur die aansoeker voorgelê nie, kan hy of sy ’n verhoor saamroep om ’n aansoek te oorweeg op sodanige datum, tyd en plek wat hy of sy bepaal. (3) Die aansoeker en enige belanghebbende persoon wat die Nasionale Lisensiëringsbeampte kan vra om by die verhoor teenwoordig te wees, moet ten minste 10 dae voor die datum van die verhoor skriftelik in kennis gestel word van die datum, tyd en plek van die verhoor. A licence may be suspended, withdrawn or amended by the National Licensing Officer if the applicant no longer meets a licence condition. The applicant must stop the training, exhibition or use of an animal for safeguarding if the licence is refused, suspended, cancelled or withdrawn.
3K. A licence is valid for use anywhere within the Republic of South Africa, unless the exhibition, training for exhibition of any animal or use of an animal for safeguarding is specifically prohibited in terms of any Provincial law or Municipal by-law in force within that specific jurisdic- tion. Suspension, withdrawal or amendment of licence 3L. (1) The National Licensing Officer may suspend, withdraw or amend a licence if the applicant no longer complies with any condition subject to which the licence was issued. (2) The National Licensing Officer may not suspend, withdraw or amend a licence, unless the licence holder in question has been— (a) informed of the intended suspension, withdrawal or amendment and the grounds upon which it is based; and (b) afforded a reasonable opportunity to make written representations or to rectify any deficiency within the period specified by the National Licensing Officer. 3M. A person who feels aggrieved by any decision or action by the National Licensing Officer in terms of this Act may appeal in the prescribed manner to the Minister against such decision or action. 30 Appeal Board, composition and membership 3N. (1) The Minister may constitute a board known as the Appeal Board to investigate and consider any appeal referred to it in terms of section 3O(1). (2) The Board must consist of at least three members appointed by the Minister, of whom— (a) one person must be appointed on account of his or her knowledge in (b) the relevant fields of the law; and two or more persons must have expert knowledge of the subject of the appeal. (3) The person referred to in subsection 2(a) must be designated as the chairperson. (4) The remuneration of a member of the Board must be prescribed. 3I. Die Nasionale Lisensiëringsbeampte moet, binne sewe dae nadat ’n besluit geneem is, die aansoeker skriftelik verwittig van die toestaan, weiering of wysiging van die lisensie en die aansoeker in kennis stel van die datum, tyd en plek vir die afhaal van die lisensie. 5 Duur van lisensie 3J. ’n Lisensie is geldig vir ’n tydperk van 12 kalendermaande vanaf die datum van uitreiking daarvan. (1) Die Nasionale Lisensiëringsbeampte kan ’n lisensie opskort, intrek of wysig as die aansoeker nie meer voldoen aan ’n voorwaarde waarkragtens die lisensie uitgereik is nie. (2) Die Nasionale Lisensiëringsbeampte mag nie ’n lisensie opskort, intrek of wysig nie, tensy die betrokke lisensiehouer— (a) verwittig is van die voorgenome opskorting, intrekking of wysiging en 20 (b) die gronde daarvoor; en ’n redelike geleentheid gegun is om, binne die tydperk deur die Nasionale Lisensiëringsbeampte vermeld, skriftelik vertoë te rig of om enige tekortkoming reg te stel. (3) Indien ’n lisensie geweier, opgeskort, gekanselleer of ingetrek word, moet ’n aansoeker die afrigting, vertoning of gebruik van ’n dier vir beveiliging, staak. Reg op appèl 3M. ’n Persoon wat te na gekom voel deur enige besluit of handeling van die Nasionale Lisensiëringsbeampte ingevolge hierdie Wet, kan op die voorgeskrewe wyse by die Minister appèl aanteken teen die besluit of handeling. Appèlraad, samestelling en lidmaatskap 3N. (1) Die Minister kan ’n raad bekend as die Appèlraad saamstel om enige appèl wat ingevolge artikel 3O(1) daarheen verwys is, te oorweeg. (2) Die Raad moet uit ten minste drie lede bestaan wat deur die Minister aangestel is, waarvan— (a) een persoon op grond van sy of haar kennis in die tersaaklike velde van (b) die reg aangestel moet word; en twee of meer persone kundig oor die onderwerp van die appèl moet wees. (3) Die persoon in subartikel 2(a) bedoel moet as die voorsitter aangewys word. (4) Die vergoeding van ’n lid van die Raad moet voorgeskryf word. (a) (4) The chairperson may, for the purposes of the hearing of an appeal— summon any person who may have material information concerning the subject of the hearing or who has in his or her possession or custody or under his or her control any document which has any bearing upon the subject of the hearing, to appear before the Board at a date, time and place specified in the summons, to be questioned or to produce that document, and the chairperson may retain for examina- tion any document so produced; and (b) administer an oath to or accept an affirmation from any person called as a witness at the hearing. (5) A person who appeals in terms of section 3M and the National Licensing Officer may be represented. (6) If a member of the Board— (a) dies during the investigation of the appeal or so soon before the commencement of the investigation that the vacancy cannot be filled in time; is unable to act and another person cannot be appointed in time; or is, after therewith, the investigation has commenced, unable to continue (b) (c) the parties may agree that the investigation be continued by the remaining members of the Board. (7) Where the member of the Board who has died or has become incapacitated as envisaged in subsection (6) was or is the chairperson of the Board, the Minister must designate one of the remaining members of the Board to act as chairperson. Section 11 of the principal Act is hereby amended—
This section amends the definition of “animal,” adds definitions for “Animal Scientist” and “Board,” and states a penalty of up to R20 000 or up to five years’ imprisonment for a regulation offence.

(1) ’n Lisensie ingevolge die herroepte artikel 2 van hierdie Wet uitgereik of ’n sertifikaat ingevolge die herroepte artikel 3 van hierdie Wet uitgereik, word geag ingevolge artikel 3I van hierdie Wet uitgereik te wees en bly geldig totdat die lisensie of sertifikaat verstryk of deur die Nasionale Lisensiëringsbeampte opgeskort, gekanselleer, ingetrek of gewysig word. (2) Enigiets gedoen of enige besluit geneem ingevolge die herroepte artikel 2 of 3 van hierdie Wet word geag deur die Nasionale Lisensiërings- beampte gedoen of geneem te gewees het. (3) Enige aansoek om ’n lisensie of sertifikaat wat voor die inwerkingtreding van die Wysigingswet op Beskerming van Gedresseerde Diere, 2016, gedoen is, moet deur die Nasionale Lisensiëringsbeampte verwerk word ooreenkomstig enige maatstawwe in die herroepte artikels 2 en 3 van hierdie Wet vervat. (4) Enige ondersoek gedoen of strafregtelike verrigtinge hangende voor ’n hof voor die inwerkingtreding van die Wysigingswet op Beskerming van Gedresseerde Diere, 2016, moet verwerk en afgehandel word asof artikels 2 en 3 van hierdie Wet nie herroep is nie.’’.
