Sheria ya Marekebisho (Na.2) ya Sheria ya Mabadiliko ya Katiba ya Mwaka 2013

1. T his A ct m ay be cited as the C onstitutional R eview (Amendment No. 2) Act, 2013 and shall be read as one with the Constitutional Review Act, hereinafter referred to as the “principal A ct”.

2. The principal Act is amended in section 22 by: (a) deleting paragraph (c) o f subsection (1) and substituting Construc­ tion Amend­ ment o f section 22 for it the following: “(c) two hundred and one members appointed by the P resident in agreem ent w ith the President o f Zanzibar as follows: (i) twenty members from Non-Governmental Organisations; tw e n ty m e m b ers fro m F a ith B ased Organisations; (ii) 9 No. 9 Constitutional Review (Amendment No. 2) 2013 (iii) (iv) (v) (vi) (vii) fro m L e a rn in g forty two members from al 1 fully registered Political Parties; tw en ty m e m b e rs Institutions; twenty members from groups o f persons with disabilities; nineteen m em bers from T rade U nion Organisations; ten m e m b e rs representing livestock keepers; a s s o c ia tio n s from (viii) ten members from fisheries associations; (ix) tw en ty m e m b e rs from a g ric u ltu ra l associations; and twenty members from any other groups o f persons having com mon interest; (x) (b) deleting subsection (2A) and substituting for it the following: “(2A) The President shall invite each group specified under subsection (1 )(c) from both sides o f the union to submit to him a list o f not less than four names and not more than nine names for consideration o f appointment, provided that, the list shall- (a) for every name proposed, indicate the age, gender, experience, qualifications and place o f abode for that person; take into consideration gender parity.’' (b) Amend­ ment ol’section 24 (c) deleting the word ‘"balance*’ appearing in paragraph (b) o f subsection (213) and substituting for it the word “parity."

3. The principal Act is amended in section 24 by: (a) adding immediately after subsection (1) the following new subsection: "(2) Notwithstanding the provisions o f subsection (1). the Clerk o f the National Assembly and the Clerk 10 i No. 9 Constitutional Review (Amendment No. 2) 2013 o f the H ouse o f R epresentatives shall, before the p ro clam atio n o f the C on stituent A ssem bly, m ake necessary preparations for better carrying out o f the Constituent Assembly business.” (a) renam ing subsections (2) to (6) as subsections (3) to (7); (b) deleting the word “secondm cnt” appearing in the renamed subsection (6) and substituting for it the word “attachm ent.”

4. The principal Act is am ended in section 26 by deleting subsections (3), (4), (5), (6) and (7).

5. The principal Act is amended in Part VI by: (a) deleting the heading and substituting for it with the following “GENERAL PROVISIONS”; (b) repealing sections 31 to 36; (c) renum bering sections 37 and 38 as sections 3 land 32 respectively.
