The Firearms and Ammunition Control Act, 2015

This section gives the Act’s short title and says the Minister appoints its commencement date by notice in the Gazette.

This section says the Act applies in Mainland Tanzania and Tanzania Zanzibar to firearms, except armaments, and allows the Minister to exempt categories of firearms or ammunition by Gazette notice.

This section defines “airgun” as a device made to discharge a bullet or other projectile below a stated calibre threshold.

This section defines terms used in the Act, including firearms-related objects, approved storage facilities, and key authorities like the Registrar and Minister.

The Inspector General of Police is designated as the National Focal Point, which must serve as the national contact and liaison on firearms and ammunition implementation matters.

You generally need a licence or permit before possessing a firearm, and a firearm permit holder must use the firearm only on an accredited shooting range under the range rules and any Registrar conditions.

A firearm licence cannot be issued unless the person meets listed conditions, including being at least 25, competent, a Tanzanian citizen or residence permit holder, mentally stable, and not convicted of the listed offences.

People applying for a firearms licence or permit must take approved competency training and shooting range classes, and the Registrar issues a competency certificate after successful completion.

The Minister may recognize certain foreign firearms licences by Order, and diplomats arriving with firearms and ammunition must apply for endorsement to the Ministry of Foreign Affairs.

The Registrar must issue a separate licence for each firearm.

Firearms approved for collection must be stored in a private collection, and anyone who wants to own one must apply for a licence from the Registrar.

The Registrar may issue firearm licences for business purposes, and licence holders must use the licence only for its stated purpose, keep records, store and transport firearms as prescribed, and produce firearms and licences for inspection when requested. There are limits on who may be given a firearm for use.

The Registrar may issue a firearm permit, cancel it if its conditions are violated, and must send an annual report to the Inspector General of Police. Permit holders must dispose of or store the firearm under conditions imposed by the Registrar.

A firearm licence must not be issued unless the firearm has the manufacturer’s serial number or another identification mark that can identify it.

Firearms and small arms must be marked with a national identification code, and owners must submit eligible firearms for marking and report tampering immediately.

A person must not possess a firearm or firearm part unless they have the required permit or are otherwise authorised by written law.

A person must not possess ammunition unless they have the required licence or permit, or are otherwise authorised by other written law.

A firearm-licence holder must not possess more than the ammunition they are authorised to keep.

The Minister may, after consulting the relevant authority in Tanzania Zanzibar and by notice in the Gazette, prohibit or restrict certain classes of ammunition.

The Registrar approves ammunition collections and may issue permits for private possession and storage, while private collectors are limited to 200 rounds and need approval to discharge ammunition.

The Registrar may issue a licence or permit for a public collector to possess firearms and ammunition, and permit holders must stay within the ammunition limit and must not discharge ammunition in their collection.

The Registrar may declare certain licence or permit applicants or holders unfit to possess firearms, and a declared unfit person must surrender firearms, ammunition, and related documents to the nearest police station as soon as practicable.

An importer of firearms and ammunition must, after getting a permit and following transport directions, immediately deposit the items in an approved firearms warehouse or police station at the importer’s own expense, unless the firearms and ammunition were imported by or for use by the Government.

Importers of firearms and ammunition must keep records, provide information for record-keeping when asked, and register imported firearms and ammunition used for business purposes when first deposited.

Firearms or ammunition stored in the listed places cannot be withdrawn unless the Registrar signs a permit.

The Inspector-General of Police may set storage directives and charge fees for firearms or ammunition held by police, and may seek forfeiture if storage fees are unpaid or the items have been stored too long.

A person may carry, possess, or use firearms or ammunition in Tanzania Zanzibar, but must store them according to the Registrar’s directives after use.

The Registrar may not issue certain firearms-dealing permits unless the Armament Control Advisory Board has been consulted and approval obtained. A person who wants to deal in firearms or ammunition business must get a dealer’s permit, and a company applicant must be registered under the Companies Act.

The Minister may make regulations about dealer permits, dealer premises, renewal, suspension, and cancellation, and must consult the relevant authority in Tanzania Zanzibar.

A dealer must operate a firearms or ammunition business only on the premises named in the dealer’s permit.

Dealers must keep prescribed registers at their business premises, display their permit conspicuously, produce stock, permit and required records for inspection on the Registrar’s request, and authorised dealers must file transaction returns in the prescribed form.

If a Part III licence holder stops carrying on business, they must keep any firearms and ammunition they have in safe custody at a place designated by the Registrar.

A permit under this Part does not exempt the permit holder from other written laws on business licensing.

A person must not manufacture or assemble firearms or ammunition in Tanzania unless it is done under the terms of a permit issued by the Armament Control Advisory Board.

A person may not repair a firearm unless they hold a gunsmith’s permit. Firearms must be repaired at Government arsenals or by a licensed gunsmith.

The Registrar must not issue a gunsmith’s permit unless the applicant is approved by the Armament Control Advisory Board.

The Minister may consult the relevant authority in Tanzania Zanzibar and prescribe rules for gunsmith’s permits, including issuance, renewal, conditions, and business-premises specifications.

A person must not, for a fee or similar payment, negotiate or arrange contracts, purchases, sales, or transfers of firearms and ammunition for others unless holding a broker's permit under the Act.

The Minister may prescribe rules for broker permits and broker premises, after consultation and Board approval.

A broker’s permit cannot be issued for operations in Tanzania unless the broker is approved by the Armament Control Advisory Board.

People importing, exporting, or moving firearms or ammunition through Tanzania generally need a permit, and each consignment needs a separate permit.

The Minister may grant, suspend, refuse, renew, or cancel transit permits for importing arms or ammunition to contiguous states.

The Minister may make regulations about permit procedures, conditions, applicant qualifications, and identification marks, after consulting the relevant authority of Tanzania Zanzibar.

Permit holders must show firearms, ammunition, their permit, and any Act-based records to the Registrar on request. Dealers must keep records of firearms and ammunition importation or sale in the manner prescribed by the Registrar.

A person must not transport firearms or ammunition without a transporter’s permit.

The Minister may, after consulting the relevant authority in Tanzania Zanzibar, set the procedure and permit conditions for transporter’s permits and the qualifications of permit holders.

A transport permit holder must let an authorized officer inspect firearms, the permit, relevant records, and other relevant information, and a transporter must keep required transport records and provide required information.

A permit under this Part does not excuse the holder from complying with other written laws regulating business licensing.

Authorized officers may search people, vehicles, vessels, aircraft, premises, and seize firearms or ammunition in specified circumstances; certain officers are also protected from suit for good-faith acts under the Act.

If a firearm licence holder dies or ceases to exist while still holding a firearm, the registrar must dispose of the firearm as prescribed by regulations.

A court may order a firearm or ammunition connected with an offence to be forfeited to the Government.

A court may order ownerless firearms or ammunition to be forfeited to the Government, and the Government must dispose of forfeited items as the court’s destruction order specifies.

The Central Firearms Registry must be located at Police Headquarters, and the Registrar must send a monthly record of issued permits and licences to the Central Arms Registry.

People who have firearms or ammunition in their possession, control, or custody must take reasonable precautions and follow security measures prescribed by the Registrar.

A person who breaches any provision of the Act commits an offence and may be fined, imprisoned for up to ten years, or both, unless another relevant law already provides a penalty for a similar offence.

A person must keep any firearm or ammunition in lawful possession in safe custody, or commit an offence.

If a lawfully held firearm or ammunition is lost, stolen, or destroyed, the holder must report it in person or through a written-authorized person within seven working days after learning of it.

If an accused person was lawfully in possession of, licensed to possess, or authorised to possess a firearm or ammunition, that can be treated as sufficient evidence if the item is not produced on request and there are no reasonable grounds for the failure, or if the loss, theft, or destruction was not reported as required.

The Minister may declare an amnesty for unlawful possession of a firearm or ammunition, by Gazette notice and after consultation, and people who surrender items under this section must not be prosecuted.

The Minister may declare an area or premises a firearm-free zone, and an authorized officer may search, seize firearms or ammunition, and arrest people in certain circumstances.

The Minister may require licence holders to verify their firearms or ammunition records if it is in the public interest and after consulting the relevant authority in Tanzania Zanzibar.

The Inspector General of Police may, after consulting the Minister, authorize any person to take part in regional joint operations to combat illicit proliferation of firearms and ammunition.

The Inspector General of Police may share information with a foreign state’s appropriate authority and may receive and act on investigation information about unlawfully possessed firearms or ammunition.

Several listed weapons are not treated as lethal weapons, and the Minister can exempt other devices by notice in the Gazette.

Imitation firearms or toy guns are treated as offensive weapons for section 286, and the Minister may make regulations on how they are imported.

The Registrar must charge fees for services rendered under this Act, and the amount is whatever the regulations prescribe.

The Minister may make regulations about firearms and ammunition matters, after consulting the relevant authority in Tanzania Zanzibar.

This provision repeals the Arms and Ammunition Act.

Some subsidiary legislation and appointed officers continue under this Act despite the repeal of the Arms and Ammunition Act.

This Part must be read together with the Local Government (Finance) Act.

This section amends section 7 by deleting subsection (1)(l) and renumbering paragraphs (m) to (z) as (l) to (y).

Committee members serve for four years and may be re-appointed for one more term. The Minister may change the membership list and must consider gender balance and balance between Mainland Tanzania and Tanzania Zanzibar when appointing members.

If a committee member is absent because of illness, infirmity, or being outside Tanzania, the appointing authority may appoint someone else, and the substitute ends when the substantive member takes office again. If the member does not resume office within six months, the Minister must confirm the substitute into office.

The Committee must elect a Vice-Chairman from among its members. The Vice-Chairman serves for one year from election and may be re-elected for one more term.

The Chairman presides at Committee meetings. If the Chairman is absent, the Vice-Chairman presides. If both are absent, the members present may appoint a temporary Chairman who must preside at that meeting.

The Committee must meet at least four times a year, special meetings can be convened by the Chairman or Vice-Chairman in some cases, and the Executive Secretary must give each member adequate notice of meeting time and place.

A Committee meeting has a quorum only if at least half of the members currently in office are present.

At Committee meetings, questions must be decided by consensus.

The Committee must record minutes of all its meetings in a book kept for that purpose.

If a member misses three consecutive Committee meetings without reasonable cause, the Committee must tell the appointing authority, and the appointing authority may end that member’s appointment and replace them.

The Committee may regulate its own proceedings.

This provision is titled “Offences under the Prevention of Terrorism Act.”

This provision is a heading for offences under the Drug and Preventions of Illicit Traffic in Drugs Act.

This section is about offences under the Anti-Money Laundering Act.

Conspiracy, incitement, or attempt to commit offences listed in this Schedule is covered by this provision.

Each State Party must establish or maintain an effective export/import licensing or authorization system, and measures for international transit, for transfers of firearms, parts, components, and ammunition.

Before issuing export licences or authorizations for firearms, their parts, components, and ammunition, each State Party must verify the importing State has issued import licences or authorizations and that the transit State has given prior written no-objection notice.

Export and import licences or authorizations, with accompanying documents, must include specified shipment and recipient information.

On request, the importing State Party must tell the exporting State Party when the dispatched firearms, parts and components, or ammunition have been received.

Each State Party must take necessary measures, within available means, to keep licensing or authorization procedures secure and allow document authenticity to be verified or validated.

States Parties may use simplified procedures for temporary import, export, and transit of firearms, parts, components, and ammunition when the purpose is verifiable and lawful.

This provision gives the section title and indicates a national administrator in the administrative provisions section.

This section gives the Act its name and says it will start in operation on a date appointed by the Minister in a Government Gazette notice.

The Act applies in Tanzania Mainland and Zanzibar, and to all weapons except military weapons. The Minister may exempt any group of weapons or ammunition by notice published in the Government Gazette.

Applicants for firearms licences or permits must take approved safety and target-practice training, and the Registrar issues a competence certificate after successful training.

The Minister may recognize certain foreign firearm licences or certificates as valid in Tanzania, and may amend the Third Schedule to add countries with reciprocal recognition.

This section concerns how weapons are to be stored after a business has stopped, and mentions changing locations.

Section 41 concerns conditions for a gunsmith’s permit.

The Registrar may not issue most firearm activity permits unless the Firearms Control Advisory Board has been consulted and has approved.

The Minister may make regulations, after consulting the relevant authorities for Zanzibar, about seller licences, conditions set by the Registrar, the seller’s business premises, reissue of the licence, and temporary suspension or cancellation of the licence.

A weapons dealer must operate only in the location stated in the dealer’s permit, and must apply to the Registrar if seeking to change location.

Sellers must keep a register at their business premises, display the seller’s permit openly, make specified items available for inspection when required by the Registrar, and licensed sellers must file business returns within the stated form period.

If a Part Three license holder stops business, they must store firearms and ammunition at a place named by the Registrar.

This section is about import, export, and transit within the country, and mentions a licence for transit of weapons to a neighbouring country.

This provision refers to transport of weapons and ammunition and a carrier permit.

Section 52 is titled about conditions for transporting firearms, but no operative rule is stated in the provided text.

A person must not transport weapons or ammunition unless they have a transporter’s permit.

The Minister may, after consulting the relevant Zanzibar authority, set rules for issuing, suspending, cancelling, or reissuing a carrier’s permit, plus the permit conditions and the permit holder’s qualifications.

A transporter permit holder must show specified arms, ammunition, permit, records, and other inspection-relevant information when required, and a transporter must keep records of all transported ammunition and provide required information to the authorized officer.

A permit under this section does not exempt the permit holder from complying with other Parliamentary laws on business licensing.

Section 54 is titled “Search and seizure” and includes a note about protection for a person sold a firearm.

An authorized officer may stop and search people, vehicles, vessels, or aircraft, and may enter and seize firearms or ammunition when there are reasonable grounds to suspect unlawful storage or related unlawful handling.

The text lists headings about firearms handling when death occurs, confiscation of firearms and ammunition, safekeeping, storage, reporting loss, and other matters.

If the owner of a weapon dies while the weapon is still being held in that ownership arrangement, the weapon is to be dealt with as provided in the regulations.

Firearms or ammunition found without an identifiable owner may be confiscated by the Government, and if confiscated by court order they must be destroyed as ordered.

Section 69 is titled “Categories of non-dangerous weapons.”

This section repeals the Arms and Ammunition Act.

A person who lawfully owns weapons or ammunition must store them safely, or face an offence and possible fine, imprisonment, or both.

A lawful possessor of a firearm or ammunition must report any loss, theft, or damage within seven working days of discovering it.

If it is proved that a defendant was the lawful owner of, or held a licence to possess, a firearm or ammunition suspected to be lost, stolen, or destroyed, that can be conclusive evidence of the loss, theft, or destruction and of failure to report it as required.

The Minister may declare certain areas, buildings, or groups of buildings to be places where firearms are not allowed. An authorised officer may search, seize firearms or ammunition, and arrest a person if there is reason to believe firearms are being kept in such a place.

The Inspector General of Police may, after consulting the Minister, authorize any person to take part in regional joint operations to help control the illegal spread of firearms and ammunition.

The section refers to sharing information with a competent authority in another country on request, and to receiving and handling information from investigations about unlawfully held weapons or ammunition.

This section says certain listed items are not treated as weapons, and the Minister may exempt other devices by Government Notice after consulting the relevant authority in Zanzibar Tanzania.

Imitation weapons are treated as dangerous weapons for Penal Code section 286, and the Minister may make regulations for importing imitation weapons or toy guns.

The Registrar must charge fees for services under this Act at a rate set by regulations.

The Minister may make regulations on the listed firearms and ammunition matters, after consulting the relevant Zanzibar authority.

A firearm license must not be issued unless the weapon has the manufacturer’s identification number or another identifying mark.

A person must not possess a firearm or any part of a firearm unless licensed or otherwise authorised. The Minister may also prohibit or restrict the taking, sale, possession, or use of firearms or firearm parts, and a breach is an offence punishable by five years’ imprisonment if convicted.

A person must not possess bullets unless they have a valid licence or are otherwise authorized under another law.

A license holder may not possess more than what the licence allows, except for an authorised licence holder in relation to ammunition bought and fired at an approved target range.

The Minister may, by Gazette notice and after consulting the relevant Tanzania Zanzibar authority, prohibit or restrict the taking, sale, possession, or use of specified bullets when it is for the public benefit or needed to maintain peace and order.

The Registrar approves how many bullets an authorized institution may store, and may issue permits for firearms in private museums. Private custodians may not hold more than 200 bullets unless the Registrar approves a higher amount in writing.

The Registrar may issue a permit for a public curator to hold arms and ammunition for a public museum, after consulting the Director of Antiquities. Permit holders must stay within the 200-round limit unless the Registrar authorizes more in writing, display the items at approved museums under regulatory conditions, and a safe-use permit holder must not fire any ammunition in custody.

An importer of firearms and ammunition must, after getting permission and following transport instructions, immediately deliver them to public stores or a police station for safekeeping at their own cost, unless the items were imported for Government use.

Importers of firearms and ammunition must keep records before removing items, provide information for record-keeping when required, and commercial imports must be registered when first entered into a public warehouse or police station.

Firearms or ammunition stored in the listed places may not be removed unless the Registrar signs a permit.

The Inspector General of Police may issue storage directions for arms and ammunition that come into police possession, charge a storage fee, and apply for forfeiture in certain cases. If the magistrate is satisfied about notice and an opportunity to pay or take legal steps, the arms or ammunition must be forfeited to the Government.

The Police Commissioner for Zanzibar is the Registrar. A firearms possession licence issued in Mainland Tanzania is not valid in Zanzibar unless signed by the Registrar or an authorized officer. A person may carry, possess, or use firearms or ammunition in Zanzibar, but after use must store them according to the Registrar’s instructions.

A permit issued under this section does not exempt the permit holder from complying with other laws related to business licensing.

A person may not make or assemble weapons or ammunition in Tanzania unless the permit conditions issued by the Arms Control and Advisory Board are followed.

A person may repair a firearm only if they hold the required gunsmithing licence, and firearms must be repaired only in a government workshop or by a licensed gunsmith.

Waziri may, after consulting the relevant Zanzibar authorities, set details for issuing, temporarily suspending, cancelling, and reissuing a firearm manufacturing licence, as well as conditions the Registrar may attach and details about the business area for firearm manufacturing.

A person must not arrange or negotiate the sale, purchase, exchange, or contracting of weapons and ammunition for someone else in return for payment, commission, or other benefit unless the person holds a dealer’s licence under the Act.

The Minister may, after consulting the relevant Zanzibar authorities, direct how firearm-dealer permits are issued, temporarily suspended, or reissued, what conditions the Registrar may attach to agency permits, and what details concern an agent’s business premises.

An agency licence for business operations in Tanzania must not be issued unless the seller has been approved by the Arms Control and Advisory Board.

Committee members serve for four years, may be reappointed once, and the Minister may change the committee members list.

If a committee member cannot attend because of illness, disability, or absence in Tanzania without good cause, the appointing authority may appoint a replacement. The replacement stops serving when the original member returns; if the original member does not return within six months, the Minister confirms the replacement in office.

The committee must choose one of its members to be Vice Chair. The elected Vice Chair holds office for one year from the date of election and may be elected again for one more term.

The Chairperson must preside over all committee meetings; if the Chairperson is absent, the Vice Chairperson presides; if both are absent, the members present may choose an acting Chairperson to preside.

The committee must meet at least four times a year, the Chairperson or Vice Chairperson may call a special meeting after requests from at least five members, and the Executive Secretary must notify every member of the time and place of each meeting in good time.

A Committee meeting has quorum only if at least half of the members are present.

Committee meetings must decide all matters by consensus.

The committee must keep records of all its meeting activities in a special book for that purpose.

If a committee member misses three consecutive committee meetings without good reason, the committee must notify the appointing authority, which may suspend that member’s appointment and appoint a replacement.

The committee may set its own procedure for conducting its meetings.

Each Member State must create and keep a special licensing system for export, import, authorization, and transit conditions for weapons.

Before export licences or authorizations for arms, ammunition, and spare parts are issued, each member state must ensure the importing state has the needed import licence/authorization and, for transit countries, a written no-objection notice before shipment.

Export/import arms licences and related documents must include specified details, and import-licence information must be given in advance to transit countries.

An importing member state must notify the exporting member state that it has received the firearms or spare parts, and the ammunition shipped, after an application is submitted.

Each Member State must take necessary measures to make licensing or authorization procedures substantive and to ensure the validity of issued licenses or authorization documents can be verified.

Member States may use ordinary procedures for the temporary import, export, and transit of weapons, parts, and ammunition for proven purposes such as hunting, sport target shooting, evaluation, exhibitions, or repair.
