Purpose and legislative effect

Sheria hii inaitwa Sheria ya Miamala ya Kielektroniki ya mwaka 2015, na kuanza kwake kutumika kutategemea tarehe itakayoteuliwa na Waziri kwa tangazo kwenye Gazeti la Serikali. This provision says the Act applies in Tanzania Mainland and Tanzania Zanzibar, except for Part Three. This section defines key terms used in the Act, including computer system, electronic communication, electronic signature, electronic record, data, user, sender, minister, and related concepts. A data message cannot be denied legal effect, validity, or enforceability just because it is electronic. An electronic information or transaction can satisfy a required non-electronic or written form if it is in a similar form, can be accessed for reference, and can be retained by the other person.

Section 1
Public institutions may handle information, documents, and services electronically, and written or signed requirements should not block electronic use.
Section 13
An automated system must let a person correct input errors in electronic communications, and a person may withdraw the communication if the system does not allow correction and certain conditions are met.
Section 26
This provision amends section 10 so that the words “or in electronic form” are added after “in writing” in the proviso.
Section 39
This section amends section 8 so that the relevant wording includes “or in electronic form.”
