This Order may be cited by its stated title, and it is deemed to have come into operation on 22 February 2019. BUWSA is exempt from paying VAT on the listed goods or services, subject to paragraph 3 and any other conditions set by the Commissioner. The exemption stops, and VAT becomes due and payable, if the goods or services are used for other purposes or are sold or disposed of to someone not entitled to similar privileges. This Order may be cited by its stated title, and it is deemed to have come into operation on 22 February 2019.

1. This Order may be cited as the Value Added Tax (Exemption) (Construction of Water Treatment Plants and Rehabilitation of Bunda Urban) (Bunda Urban Wa- ter Supply and Sanitation Authority (BUWSA) Order, 2020 and shall be deemed to have come into operation on the 22th day of February, 2019.

§ 2(1) Subject to the conditions specified in paragraph 3 of this Order, and anyProvision

BUWSA is exempt from paying VAT on the listed goods or services, subject to paragraph 3 and any other conditions set by the Commissioner.

2.-(1) Subject to the conditions specified in paragraph 3 of this Order, and any other conditions as may be specified by the Commissioner, the whole of the Value Added Tax payable on the goods or services specified in the Schedule to this Order imported or purchased prior to clearance through customs or locally purchased by or on behalf of Bunda Urban Water Supply and Sanitation Authority (BUWSA) is hereby exempted. (2) For the avoidance of doubt, the goods imported or purchased locally, whether directly by the Government entity or through a contractor shall remain the property of the Government of the United Republic. The exemption stops, and VAT becomes due and payable, if the goods or services are used for other purposes or are sold or disposed of to someone not entitled to similar privileges.

3. The exemption granted under this Order shall cease to have effect and the Value Added Tax shall become due and be payable as if this exemption had not been made if the said goods or services are used for other purposes or sold or dis- posed of in any way to another person not entitled to enjoy similar privileges as are conferred under this Order.
