THE PETROLEUM (NILAMIDHU OIL SERVICE STATION)(CONSTRUCTION APPROVAL) NOTICE, 2020

1. This Notice may be cited as the Petroleum (Nilamidhu Oil Service Station) (Construction Approval) Notice, 2020. Commencement

2. This Notice come into operation from the date of publication in the Government Gazette. Interpretation

3. In this Notice, unless the context otherwise requires- “applicant” means Nilamidhu Oil Service Station of P.O Box 3, Mtwara; “Authority” means the Energy and Water Utilities Regulatory Authority established under the Energy and Water Utilities Regulatory Authority Act; and “construction approval” means an approval issued by the Authority pursuant to section 128(1) of the Petroleum Act.

4. The applicant is hereby granted a construction approval to construct a petroleum products retail outlet at Plot No. 64, Block C, Naliendele Area, Mtwara Municipality in Mtwara Regionsubject to the following conditions: Cap. 414 Cap. 392 Granting of construction approval 1 Petroleum (Nilamidhu Oil Service Station) (Construction Approval) GN NO. 322 (Conted) Cap. 340 (a) the retail station shall be constructed in accordance the Tanzania Bureau of Standards TZS with 1115:2009 and TZS 1079:2009; (b) due care shall be exercised during excavation and installation of underground tanks; (c) the layout of the retail station shall meet the minimum safety distances in accordance with Tanzania Bureau of Standards TZS 1079:2009; (d) the underground tanks and associated pipelines shall be well protected from corrosion and the back filling shall be done properly using non-corrosive materials; (e) the underground storage tanks and pumps together with the connecting pipes and fittings shall be constructed so as to prevent any leakage of fuel; (f) underground storage tanks and dispensing pumps shall be calibrated by the Weights and Measures Agency established under the Weights and Measures Act; (g) the forecourt of the retail station shall be paved with impervious materials at the pump island with a drainage provision connected to oil and water separator; (h) an emergency shut off switch shall be installed in a conspicuous and accessible area; (i) ensuring that there shall be adequate and clean toilet facilities at all times; (j) clear and visible safety warning signs shall be installed at the entrance, exit and at the dispensing pumps, including but not limited to "switch off engine", "switch off mobile phone" and "no smoking"; (k) each storage tank shall be fitted with vent pipes with a minimum height of 3.6 metres; 2 Petroleum (Nilamidhu Oil Service Station) (Construction Approval) GN NO. 322 (Conted) (l) each pump shall be protected with crash barriers with the height of one meter above the ground; (m) the offloading manhole shall be constructed in accordance with good petroleum industry practices and the offloading receiving pipes shall be provided with couplings to prevent spillages during offloading; (n) the retail station shall be covered with a canopy covering at least the pump island and constructed in accordance with good petroleum industry practices; and (o) a price board shall be erected in a conspicuous place Expiry of construction approval

5. The construction approval shall automatically expire or cease to have effect if such construction fails to take effect within twenty-four months from the date of issuance of construction approval.
