THE PETROLEUM (PAN AFRICAN ENERGY TANZANIA LIMITED) (CONSTRUCTION APPROVAL) NOTICE, 2020

1. This Notice may be cited as the Petroleum (Pan African Energy Tanzania Limited) (Construction Approval) Notice, 2020.

2. In this Notice, unless the context otherwise requires- “Applicant” means Pan African Energy Tanzania Limited (PAET) of P. O. Box 80139, Dar es Salaam; “authority” means the Energy and Water Utilities Regulatory Authority established under the Energy and Water Utilities Regulatory Authority Act; and “construction approval” means an approval issued by the Authority pursuant to section 128(1) of the Petroleum Act.

3.-(1) Subject to sub-paragraph(2) the applicant is to undertake hereby granted a construction approval construction of a CNG decompression station with virtual pipeline, decanting panels, storage, pressure regulation system and rotary gas meter at Mikoani Edible oil at Mbagala, Dar es Salaam. (2) Construction approval under paragraph (i) is granted under the following conditions- (a) comply with the approved design, technical specifications, (installation, and construction, commissioning), and demarcated right of way or other applicable laws; processes welding, testing Petroleum (Pan African Energy Tanzania Limited) (Construction Approval) GN NO. 330 (Conted) (b) ensure each natural gas pipeline or other related in accordance with or issued by Tanzania Bureau of facilities is constructed comprehensive written standards Standards or other applicable laws; specifications (c) ensure that construction inspection requirements for pipelines or other related facilities is adequate in order to assure compliance with the material, testing construction, welding, assembly, and requirements of the standards issued by the Tanzania Bureau of Standards; (d) ensure that natural gas pipeline or other related facilities are constructed within the approved route that was selected with a view to minimizing the possibility of hazards from future industrial or urban development, encroachment of the right of way or line routing, and damage to environment or historical sites; (e) ensure that there are minimal inconveniences to the residents around the facility and the safety of the public is given prime consideration. In case blasting is involved, it should be done in accordance with the governing regulations and should be performed by a competent and qualified personnel and be performed so as to provide adequate protection to the general public, livestock, wildlife, telephone, telegraph, power lines, underground structures and any other property in the proximity of the blasting; buildings, (f) ensure that in grading the right of way, every effort should be made in order to minimize damage to the land, and to prevent abnormal drainage and erosive conditions. The land is to be restored to as nearly original condition as is practical; (g) ensure that in constructing pipeline crossings railroads, highways, streams, lakes and rivers safety precautions such as sign, light, guard rails, etc., should be maintained in the interest of public safety. The crossing should comply with the applicable rules, regulations, and restrictions of regulatory bodies having jurisdiction. Prior to the crossing, arrangement should be made with the pertinent authority in charge of the facility to be crossed; (h) ensure that the route is surveyed and staked and construction of a pipeline 2 Petroleum (Pan African Energy Tanzania Limited) (Construction Approval) GN NO. 330 (Conted) such staking and marking be maintained during construction as per conditions given in the permit granted by wayleave or right of way owner; (i) the pipeline should be properly located within the right of way by maintaining survey route marker or by surveying during construction; (j) ensure that the depth of the ditch is appropriate for the route location, surface use of the land, terrain features and loads imposed by roadways and railroads. Width and grade of ditch should provide for lowering of the pipe into the ditch to minimize damage to the coating and to facilitate fitting the pipe to the ditch; (k) ensure that it takes all practicable steps to protect each pipeline or other related facilities from washouts, floods, unstable soil, landslides, or other hazards that may cause the pipeline to move or to sustain abnormal loads; (l) ensure that each line is installed with at least 12 inches (300 millimetres) of clearance from any other underground structure not associated with the gas line. If this clearance cannot be attained, the gas line should be protected from damage that might result from proximity to other structure. Each line should be installed with enough clearance from any other underground structure to allow proper maintenance and to protect against damage that might result from proximity to other structures; (m) ensure that welding equipment is of a size and type suitable for the work, and is maintained in a condition acceptable welds, ensures continuity of operation and safety of personnel; that and (n) observe environmental, health safety standards as required by the applicable laws. Health and safety of all the personnel and equipment should be taken into account and ensure use of Personal Protective Equipment (PPE) all the time including head hat, safety glasses, safety boots, use of fire extinguisher; (o) ensure all existing utilities whether regulated by the Authority or not are protected from damage and formally communicate with operators of such utilities to request their presence on site during project execution; (p) ensure warning tape is used to enclose a working area; 3 Petroleum (Pan African Energy Tanzania Limited) (Construction Approval) GN NO. 330 (Conted) (q) install pipeline protection and monitoring systems which include corrosion protection system (cathodic protection), pressure relief valves, gauges, valves, delineation of ROW, leak detection system, pigging system for cleaning and monitoring pipeline thickness and effective communication systems; pressure shutoff (r) ensure line markers including right-of-way, pipeline, aerial and venting markers are installed along the pipeline route; and (s) ensure line markers have appropriate warning signs, warning notices and emergency telephone numbers.
