THE PETROLEUM (HERI MCHUNGA ZEBEDAYO T/A NENGELO OIL) (CONSTRUCTION APPROVAL) NOTICE, 2020

1. This Notice may be cited as the Petroleum (Heri Mchunga T/A Nengelo Oil) (Construction Approval) Notice, 2020.

2. In this Notice, unless the context otherwise requires- “applicant” means Heri Mchunga Zebedayo T/A Nengelo Oil of P. O. Box 111, Somanda-Bariadi; “Authority” means the Energy and Water Utilities Regulatory Authority established under the Energy and Water Utilities Regulatory Authority Act; and “construction approval” means an approval issued by the Authority pursuant to section 128(1) of the Petroleum Act.

3. The applicant is hereby granted a construction approval to construct a petroleum products retail outlet at Isenga Area Dutwa, in Bariadi District, Simiyu Region subject to the following conditions: (a) the retail station shall be constructed in the Tanzania Bureau of accordance with Standards TZS 1115:2009 and TZS 1079:2009; (b) due care shall be exercised during excavation and installation of underground tanks; (c) the layout of the retail station shall meet the minimum safety distances in accordance with Tanzania Bureau of Standards TZS 1079:2009; (d) the underground tanks and associated pipelines shall be well protected from corrosion and the 1 Petroleum (Heri Mchunga Zebedayo T/A Nengelo Oil) (Construction Approval) GN NO. 338 (Conted) Cap. 340 back filling shall be done properly using non- corrosive materials; (e) the underground storage tanks and pumps together with the connecting pipes and fittings shall be constructed so as to prevent any leakage of fuel; (f) underground storage tanks and dispensing pumps shall be calibrated by the Weights and Measures Agency established under the Weights and Measures Act; (g) the forecourt of the retail station shall be paved with impervious materials at the pump island with a drainage provision connected to oil and water separator; (h) an emergency shut off switch shall be installed in a conspicuous and accessible area; (i) ensuring that there shall be adequate and clean toilet facilities at all times; (j) clear and visible safety warning signs shall be installed at the dispensing pumps, including but not limited to "switch off engine", "switch off mobile phone" and "no smoking"; the entrance, exit and at (k) each storage tank shall be fitted with vent pipes with a minimum height of 3.6 metres; (l) each pump shall be protected with crash barriers with the height of one meter above the ground; (m) the offloading manhole shall be constructed in industry accordance with good petroleum practices and the offloading receiving pipes shall be provided with couplings to prevent spillages during offloading; (n) the retail station shall be covered with a canopy covering at least the pump island and constructed in accordance with good petroleum industry practices; and (o) a price board shall be erected in a conspicuous place. 4. The construction approval shall automatically expire or cease to have effect if such construction fails to take effect within twenty-four months from the date of issuance of Petroleum (Heri Mchunga Zebedayo T/A Nengelo Oil) (Construction Approval) GN NO. 338 (Conted) the construction approval.
