THE PETROLEUM (BAGAMOYO SUGAR LIMITED) (CONSTRUCTION APPROVAL FOR CONSUMER INSTALLATION) NOTICE, 2020

1. This Notice may be cited as the Petroleum (Bagamoyo Sugar Limited) (Construction Approval for Consumer Installation) Notice, 2020.

2. In this Notice, unless the context otherwise requires- “applicant” means Bagamoyo Sugar Limited of P. O. Box 1191, Dar es salaam; “Authority” means the Energy and Water Utilities Regulatory Authority established under the Energy and Water Utilities Regulatory Authority Act; and “construction approval “means an approval issued by the Energy and Water Utilities Regulatory Authority pursuant to section 128 (1) of the Petroleum Act.

3. The applicant is granted a construction approval to construct a Consumer installation at Farm No. 3565/1, Makurunge Ward, Bagamoyo District in Coast Region subject to the following conditions- (a) the consumer installation shall be constructed in the Tanzania Bureau of accordance with Standards TZS 1113:2009 and API 650; (b) due care shall be exercised during installation of the above ground storage tanks; (c) the layout of the facility shall meet the minimum 1 Petroleum (Bagamoyo Sugar Limited) (Construction Approval for Consumer Installation) GN NO.346 (Conted) safety distances in accordance with Tanzania Bureau of Standards TZS 1113:2009; (d) the above ground tanks and associated pipelines shall be well protected from corrosion; (e) the above ground tanks shall be situated in a bund that have volumetric capacity of 10% more than the capacity of the largest tank in the bund; (f) above ground storage tanks and dispensing pumps shall be calibrated by the Weights and Measures Agency established under the Weights and Measures Act; Cap. 340 (g) the tanks shall be properly labelled with necessary information including earth resistance, date of installation, date of calibration, maximum and safe capacity; (h) the bund shall be constructed with impermeable concrete walls with height of not greater than

1.8m; (i) the bund surface shall be paved with concrete and provided with drainage system connected to well and properly designed oil water separator; (j) the oil water separator shall have an outlet valve conspicuously displayed operating instructions; (k) area around the fuel dispensing area and pump house shall be paved with impervious materials i.e concrete with a drainage provision connected to oil and water separator; (l) the pump house shall be outside the bund provided with appropriate spill containment, shaded with adequate ventilation; (m) an emergency shut off switch shall be installed in a conspicuous and accessible area; (n) clear and visible safety warning signs shall be the installed at dispensing pumps, including "switch off engine", "switch off mobile phone" and "no smoking signs"; the entrance, exit and at (o) there shall be adequate firefighting system including fire water supply, fire pumps, fire alarm, fire extinguisher, hydrant system and sprinkler system at the storage tank; system, bucket, foam sand 2 Petroleum (Bagamoyo Sugar Limited) (Construction Approval for Consumer Installation) GN NO.346 (Conted) (p) each storage tank shall be fitted with a vent pipe or with appropriate pressure relief valve; (q) there shall be sprinkler system provided at each storage tank; (r) each pump shall be protected with crash barriers with the height of one meter above the ground; (s) the offloading area shall be constructed in accordance with good petroleum industry practices and the offloading receiving pipes should be provided with couplings to prevent spillages during offloading; (t) there shall be earthling bonding point at the offloading area and each storage shall be properly earthed; (u) the pipelines at the facility shall be properly colour coded i. yellow strip for diesel, red fire for hydrant system, full yellow for foam system; and (v) the fuel dispensing shall be covered with a canopy covering at least the pump island and constructed in accordance with petroleum industry best practices.
