§ 1This Order may be cited as the Value AddedCommencement

This Order may be cited by its full name, and it is deemed to have come into operation on 19 June 2020.

1. This Order may be cited as the Value Added Tax (Exemption) Supply of Pipes for Rural Water Supply Projects in Katavi, Kigoma, Manyara, Singida and Tabora Region (Rural Water Supply (RUWASA)) (M/S Davis & Shirtliff Ltd) Order, 2020 and shall be deemed to have come into operation on the 19th day of June, 2020.

§ 2(1) Subject to the conditions specified inProvision

Specified goods and services for RUWASA’s pump and generator supply projects are exempt from VAT, subject to stated conditions.

2.-(1) Subject to the conditions specified in paragraph 3 of this Order, and any other conditions as may be specified by the Commissioner General of Tanzania Revenue authority (TRA), the whole of the Value Added Tax payable on the goods or services specified in the Schedule to this Order, imported or purchased prior to clearance through customs or locally purchased by or on behalf of M/s Davis & Shirtliff Ltd for RUWASA to be used solely in the Supply of supply of pump and generator for Rural Water Supply Projects in Katavi, Kigoma, Manyara, Singida and Tabora Region is hereby exempted. (2) For avoidance of doubt, the goods imported or the locally purchased, whether directly by Government entity or through a contractor shall 1 Value Added Tax (Exemption) (Supply of Pump And Generator Projects in Katavi, Kigoma, Manyara, Singida and Tabora Region) (Rural Water Supply (Ruwasa)) (M/S Davis & Shirtliff Ltd) GN. § 3The exemption granted under this OrderProvision

The exemption ends if the goods or services are used for other purposes or transferred to someone without similar privileges, and VAT then becomes due and payable.

The exemption granted under this Order shall cease to have effect and the Value Added Tax shall become due and payable as if this exemption had not been granted where the said goods or services are used for other purposes, sold or disposed of in any way to another person not entitled to enjoy similar privileges as conferred under this Order.
