THE PETROLEUM (ERNCON HOLDINGS LIMITED- BAHARI BEACH PETROL STATION) (CONSTRUCTION APPROVAL) NOTICE, 2020

1. This Notice may be cited as the Petroleum (Erncon Holdings Limited- Bahari Beach Petrol Station) (Construction Approval) Notice, 2020. Interpretation

2. In this Notice, unless the context otherwise requires- “applicant” means Erncon Holdings Limited- Bahari Beach Petrol Station of Cap. 414 Cap. 392 Granting of construction approval P.O. Box 80500, Dar es Salaam; “Authority” means the Energy and Water Utilities Regulatory Authority established under the Energy and Water Utilities Regulatory Authority Act; and “construction approval” means an approval issued by the Authority pursuant to Section 128(1) of the Petroleum Act.

3. The applicant is hereby granted a construction approval to construct a petroleum products retail outlet at Plot no 25, Bahari Beach area, Kinondoni Municipality in Dar es Salaam Region subject to the following conditions: (a) the retail station shall be constructed in accordance with the Tanzania Bureau of Standards TZS 1115:2009 and TZS 1079:2009; (b) due care shall be exercised during excavation and installation (c) (d) (e) of underground tanks; the layout of the retail station shall meet the minimum safety distances in accordance with Tanzania Bureau of Standards TZS 1079:2009; the underground tanks and associated pipelines shall be well protected from corrosion and the back filling shall be done properly using non-corrosive materials; the underground storage tanks and pumps together with the connecting pipes and fittings shall be constructed so as to prevent any leakage of fuel; (f) underground storage tanks and dispensing pumps shall be calibrated by the Weights and Measures Agency established under the Weights and Measures Act; the forecourt of the retail station shall be paved with impervious materials at the pump island with a drainage (g) 1 Petroleum (Erncon Holdings Limited- Bahari Beach Petrol Station) (Construction Approval) provision connected to oil and water separator; (h) an emergency shut off switch shall be installed in a conspicuous and accessible area; (i) ensuring that there shall be adequate and clean toilet facilities at all times; (j) clear and visible safety warning signs shall be installed at the entrance, exit and at the dispensing pumps, including "switch off engine", "switch off mobile phone" and "no smoking"; (k) each storage tank shall be fitted with vent pipes with a minimum height of 3.6 metres; Cap 340 (l) each pump shall be protected with crash barriers with the height of one meter above the ground; (m) the offloading manhole shall be constructed in accordance with good petroleum industry practices and the offloading receiving pipes shall be provided with couplings to prevent spillages during offloading; the retail station shall be covered with a canopy covering at least the pump island and constructed in accordance with good petroleum industry practices; and (n) (o) a price board shall be erected in a conspicuous place.
