Purpose and legislative effect

“This section says the Regulations may be cited as the Immigration (Amendment) Regulations, 2023 and must be read together with the Immigration Regulations, 1997.”

This section says the Regulations may be cited as the Immigration (Amendment) Regulations, 2023 and must be read together with the Immigration Regulations, 1997. This amendment adds a new definition of “buyer of real estate.” This provision says the principal Regulations are amended by inserting a new heading after the heading of Part II. Residence permits issued under these Regulations must comply with the issuance status and requirements set out in the Second Schedule Regulations. This provision amends regulation 8 by replacing “Special Pass” with “Interim Pass,” adding a new category for “Special Pass for East African Community Partner States,” and stating that each pass is subject to the issuance status and requirements in the Second Schedule.

1. These Regulations may be cited as Immigration (Amendment) Regulations, 2023 and shall be read as one with the Immigration Regulations, 1997 hereinafter referred to as the “principal Regulations.”

This amendment adds a new definition of “buyer of real estate.”

2. The principal Regulations are amended in regulation 2 by adding in the appropriate alphabetical order the following new definition: “buyer of real estate” has the meaning ascribed to it under the Tanzania Investment Act and the Zanzibar Investment Promotion Act;”. Addition of regulation 4A

§ 4The principal Regulations are amended inSubstitution

This provision amends regulation 8 by replacing “Special Pass” with “Interim Pass,” adding a new category for “Special Pass for East African Community Partner States,” and stating that each pass is subject to the issuance status and requirements in the Second Schedule.

4. The principal Regulations are amended in regulation 8 by- (a) deleting the words “Special Pass” appearing in subregulation (1)(c) and substituting for them 1 GN. NO. 428 (Contd.) Immigration (Amendment) the words “Interim Pass.” (b) adding immediately after subregulation (1)(l) the following new paragraph: “(m) Special Pass for East African Community Partner States.” (c) adding immediately after subregulation (1) the following: “(2) Each pass issued under these Regulations shall be subject to issuance status and requirements as prescribed for under the Second Schedule”; and (d) renumbering sub regulations (2) and (3) as subregulations (3) and (4), respectively.

This section amends regulation 12 by replacing references to “Special Pass” with “Interim Pass” and allowing extension or renewal for another period not exceeding three months where necessary.

5. The principal Regulations are amended in regulation 12- (a) in subregulation (1) by- (i) deleting the words “Special Pass” in the marginal note and wherever they appear in regulation 12 and substituting for them the words “Interim Pass”; (ii) deleting the words “Special Pass” appearing in TIF 7 and substituting for them the words “Interim Pass”; (iii) deleting the words “or entering” appearing in the opening phrase; (iv) deleting the words “or enter” appearing in paragraph (a) (v) adding immediately after paragraph (b) the following: “(c) in order to legalise immigration status of such person.”; and (b) in subregulation (2) by deleting the words “shall not be or renewed” and substituting for them the words “may, where necessary, be extended or renewed for another period not exceeding three months”.

A Visitor’s Pass holder is entitled to leave for any East African country and re-enter the United Republic while the pass is valid.

The Commissioner General of Immigration may issue a Special Pass to eligible East African Community partner-state persons, and may extend or renew it where necessary.

(1) A Special Pass for East African Community Partner States may be issued by the Commissioner General of Immigration to any person from the East African Community Partner States who has secured employment or temporarily conducting business, trade, profession or assignment for a period of not more than ninety days. This section amends the immigration regulations to let the Commissioner General of Immigration order removal of certain refused entrants, and makes carrier owners and persons in charge liable for a TZS 1,000,000 surcharge for each such person brought in.

9. The principal Regulations are amended in regulation 26 by adding immediately after subregulation (3) the following: “(4) The Commissioner General of Immigration shall issue direction of removal of prohibited immigrant or any other person refused to enter into the United Republic in TIF. 32 set out in the First Schedule. 3 GN. An immigration officer may investigate, arrest, search, seize documents or things, detain a suspect, and record statements, but must follow the listed procedure laws and use the required forms and receipts.

35A.-(1) An immigration officer shall conduct investigation in accordance with the procedures the Criminal provided Procedure Act, or the Criminal Procedure Act of Zanzibar, the Immigration Act and the Evidence Act or the Evidence Act of Zanzibar and in so doing may arrest, require the production of any relevant document or things, search any person or premise and seize any relevant document or thing found in possession of a suspect, place a 4 GN.
