The Civil Aviation (Aircraft Registration and Marking) (Amendment) Regulations, 2023

1. These Regulations may be cited as the Civil and Marking) Aviation (Amendment) Regulations, 2023 and shall be read as one with the Civil Aviation (Aircraft Registration and Marking) Regulations, 2017 hereinafter referred to as “the principal Regulations”.

2. The principal Regulations are amended in regulation 4 by- (a) deleting subregulation (1) and substituting for it the following: “(1) A person shall not operate an aircraft within or fly over the United Republic of Tanzania, unless- (a) the aircraft is registered by the; or (b) the aircraft is registered in- (i) a Contracting State Convention on Civil Aviation; to the International (ii) some other State in relation to which there is in force an agreement the the United Government of Republic and the government that State which makes of between Civil Avition (Aircraft Registration and Marking) (Amendment) Regulation GN. NO. 367 (Contd) provisions for the flight over the United of aircraft registered in that State. (b) (b) deleting paragraphs of subregulation (2) and substituting for them the following: and (c) “(b) an unqualified person is entitled as owner to any legal or beneficial interest in the aircraft or to any share therein”. (c) renaming paragraphs (d) and (e) as paragraphs (c) and (d) resechivery; (d) adding immediately after sub regulation (5) the following: “(6) The aircraft classification shall be as prescribed in the First Schedule to these Regulations”. 3. The principal Regulations are amended in regulation 5 (1) by inserting in paragraph (a) the words “or leased” between the words “owned” and “by”. Amendment of regulation 13

4. The principal Regulations are amended in regulation 13- (a) in subregulation (1), by adding immediately after paragraph (b) the following: to those mentioned “(c) Special cases - where a heavier-than- air aircraft does not possess parts in corresponding paragraphs (a) and (b), the marks shall appear in such a manner that the aircraft can be identified readily; “(d) marking and placards shall- (i) be on instruments, equipment, controls and any such items including such limitations or information as necessary for the direct attention of the flight crew during flight; and (ii) provide instructions with information that is essential to the ground crew in order to preclude the possibility of mistakes in ground servicing such as 2 Civil Avition (Aircraft Registration and Marking) (Amendment) Regulation GN. NO. 367 (Contd) towing and refueling that could pass unnoticed and jeopardize the safety of the aircraft in subsequent flights.” (b) in sub regulation (2), by adding immediately after paragraph (d) the following: “(e) unmanned free balloons:- the mark shall appear on the identification plate afixed conspicuously to the exterior of the payload.” Amendment of regulation 18

6. The principal Regulations are amended in regulation 18 by deleting paragraph (c) and substituting for it the following:- “(c) secured to the aircraft in a prominent position, near the main entrance, or, in the case of unmanned free balloon affixed conspicuously the payload;” the exterior of to Amendment of regulation 23

7. The principal Regulations are amended in regulation 23 by deleting the word”28 days” substituting for it the words “twentyeight days” Amendment of First Schedule
