THE PETROLEUM (SETTLEMENT OF DISPUTES ARISING FROM UPSTREAM PETROLEUM OPERATIONS) (AMENDMENT) RULES, 2024

1. These Rules may be cited as the Petroleum (Settlement of Disputes Arising from Upstream Petroleum Operations) (Amendment) Rules, 2024 and shall be read together with the Petroleum (Settlement of Disputes Arising from Upstream Petroleum Operations) Rules, 2023 hereinafter referred to as the “principal Rules”. 2. The principal Rules are amended in rule 18 by deleting the reference to “rule 18” appearing in subrule (1) and substituting for it the reference to “rule 17”. Amendment of rule 23

3. The principal Rules are amended in rule 23, by- (a) adding immediately after subrule (1), the following: “(2) The appropriate speed track of the dispute shall be determined as follows: (a) speed track one shall be reserved for a dispute considered by the Committee to be fast dispute, capable of being or are required in the interest of justice to be concluded fast within a period not exceeding four months from the date of which speed track has been set; and (b) speed track two shall be reserved for a dispute considered by the 1 Petroleum (Settlement of Disputes Arising From Upstream Petroleum Operations) (Amendment) Rules GN. No. 642 (Contd) to be Committee complex dispute, capable of being or are required in the interest of justice to be concluded within a period not exceeding ten months from the date of which speed track has been set.”; (b) deleting the reference to “subrule (3)” appearing the in subrule (4) and substituting for reference to “subrule (4)”; and it (c) renumbering subrules (2), (3), (4) and (5) as subrules (3), (4), (5) and (6) respectively. 4. The principal Rules are amended in rule 45 by deleting the words “shall be liable to a fine of not less than three million shillings” and substituting for them “commits an offence and on conviction shall be liable to the penalty prescribed under the Act”.
