THE MINING (MIRERANI CONTROLLED AREA) (AMENDMENT) REGULATIONS, 2024

1. These Regulations may be cited as the Mining (Mirerani Controlled Area) (Amendment) Regulations, 2024 and shall be read as one with the Mining (Mirerani Controlled Area) Regulations, 2019 hereinafter referred to as the “principal Regulations”. Amendment of regulation 23 “Tanzanite Exchange Centre

2. The principal Regulations are amended by deleting regulation 23 and substituting for it the following:

23.-(1) The Commission shall establish a minerals and gem house at to be known as “the Mirerani area Tanzanite Exchange Centre”. (2) The Centre shall- (a) be the centre for and exchange of all minerals obtained within Mirerani by miners, brokers, dealers and a holder of a large lapidary or a holder of a small lapidary licence; (b) be the only outlet of all won tanzanite outside Mirerani; 1 Mining (Mirerani Controlled Area) (Amendment) Regulations GN. No. 418 of 2019 (c) participate in the mineral auctions in accordance with the (Mineral and Gem Mining Houses) Regulations; and (d) conduct tanzanite marketing and promotions. this (3) The provisions of regulation shall not prevent the dealing in tanzanite minerals at any place within the following United Republic on conditions: the (a) dealing in rough tanzanite by a lapidary large holder of a licence; or (b) dealing in cut and polished Provided tanzanite minerals, tanzanite such that, minerals have been sourced through the Centre. (4) In this regulation, “Centre” means the Tanzanite Exchange Centre.”. “Offences and penalties

24.-(1) A person who contravenes the provisions of regulation 23 commits an offence and shall, upon conviction, be liable, in case of - (a) a body corporate, to a fine of not less than thirty million shillings but not exceeding fifty million shillings; and than (b) an individual, to a fine of not fifteen million less shillings but not exceeding thirty million shillings or to imprisonment for a term of not less than one year but not exceeding two years or to both. in addition to the penalties imposed under (2) The Commission may, 2 Mining (Mirerani Controlled Area) (Amendment) Regulations GN.
