§ 3(1) Mtu anapaswa kufanya muamala ndani yaOffence

People must use Tanzanian shillings for domestic transactions, and certain foreign-currency pricing, payment, advertising, or receipt practices are treated as offences.

3.-(1) Mtu anapaswa kufanya muamala ndani ya nchi kwa kutumia shilingi ya Tanzania pekee. (2) Kwa kuzingatia masharti ya kanuni ndogo ya (1), mtu anatenda kosa endapo atafanya yafuatayo: atasaidia (a) atalazimisha, au atashiriki, kuwezesha upangaji bei ya bidhaa au huduma yoyote nchini kwa kutumia fedha ya kigeni; (b) atanukuu, atatangaza, au kuchapisha bei ya bidhaa au huduma yoyote nchini kwa kutumia fedha ya kigeni; atabainisha (c) atalazimisha au kuwezesha malipo ya bidhaa au huduma yoyote nchini kufanyika kwa kutumia fedha ya kigeni; (d) atakataa bidhaa au huduma yoyote nchini kulipiwa kwa kutumia shilingi ya Tanzania; au (e) atapokea malipo ya bidhaa au huduma ndani 1 Tangazo la Serikali Na. 198 (Linaendelea) Kanuni za Matumizi ya Fedha za Kigeni ya nchi kwa kutumia fedha ya kigeni. (3) Kwa madhumuni ya kanuni ndogo ya (1), “muamala” maana yake ni kunukuu, kutangaza, kubainisha, kuchapisha au kupanga bei au kulipa au kupokea malipo ya bidhaa au huduma ndani ya nchi. 5.-(1) Mtu yeyote hataruhusiwa kuingia mkataba wa bidhaa au huduma kwa malipo ya fedha ya kigeni ndani ya nchi, isipokuwa kwa mkataba unaohusisha malipo yaliyoruhusiwa kwa mujibu wa masharti ya kanuni ya 4. (2) Bila kuathiri kanuni ndogo ya (1)- (a) malipo kwa ajili ya wafanyakazi, huduma au bidhaa zitakazonunuliwa nchini wakati wa utekelezaji wa mkataba yatafanyika kwa kutumia shilingi ya Tanzania, isipokuwa kwa mikataba itakayoruhusiwa kwa mujibu wa kanuni ya 4; (b) mkataba wowote wa utoaji wa bidhaa au huduma ndani ya nchi ulioingiwa kwa fedha ya kigeni kabla ya kuanza kutumika kwa Kanuni hizi utapaswa kufanyiwa marekebisho ndani ya muda wa mwaka mmoja tangu tarehe ya kutangazwa kwa Kanuni hizi. (3) Mkataba ambao hautafanyiwa marekebisho ndani ya muda ulioainishwa katika kanuni ndogo ya (2)(b) utakuwa batili isipokuwa pale ambapo Waziri atatoa idhini ya kuongeza muda usiozidi muda wa mkataba ulioingiwa. 2 Tangazo la Serikali Na. 198 (Linaendelea) Kanuni za Matumizi ya Fedha za Kigeni _________ JEDWALI _________ (Limetengenezwa chini ya kanuni ya 4) ORORDHA YA MIAMALA INAYOWEZA KUFANYIKA KWA FEDHA YA KIGENI Na.
