(3) The Common Seal of the University shall - (a) be kept in such custody as the Council may direct and shall not be used except upon the order of the Council; (b) be authenticated by the signature of the Vice-Chancellor, or of one other member of the Council duly authorized by the Council in that behalf and of the Deputy Vice-Chancellor responsible for administration; and (c) when affixed to any document and duly authenticated under this Regulation, be judicially noticed, and, unless the contrary is proved, any necessary order or authorization of the Council under this Rule shall be presumed to have been duly given. (4) The university shall be successor to the University of Dar es Salaam established by the University of Dar es Salaam Act, (now repealed) and subject to this Charter and the prescribed Rules - (a) all subsisting and valid appointments and terms and conditions of service, enrolments, authorizations, decisions and pending disciplinary proceedings, other things, including rights and liabilities made, given, taken, done or incurred under the repealed Act, shall be deemed to be valid, continuous and enforceable according to their respective tenor by or, as the case may be, against the University; all funds, assets both movable and immovable, including institutions of the University of Dar es Salaam subsisting at the commencement of this Charter shall, without further assurance, automatically and fully vest in the University and the Council; (b) 5 GN.
