The Grazing -Land and Animal Feed Resources (Import and Export of Animal Feed Resources) (Ammendment) Regurations 2022

1. These Regulations may be cited as the Grazing – Land and Animal Feed Resources (Import and Export of Animal Feed Resources) (Amendment) Regulations, 2022 and shall be read as one with the Grazing – Land and Animal Feed Resources (Import and Export of Animal Feed Resources) Regulations, 2021 hereinafter referred to as the “principal Regulations”.

2.The principal Regulations are amended by adding immediately after regulation 20 the following: “Suspensi on or cancellati on to comply with "20A.-(1) The Director shall, where a the person failed conditions for import or export as provided for under these Regulations, suspend or cancel the permit or certificate of registration of import or export of animal feed resources any time before the date of expiry. (2) Subject to subregulation (1) the Director shall issue a notice of ninety days of his intention to suspend or cancel the permit or the certificate. (3) Where the certificate or permit is suspended by the Director under these Regulations, the holder of 1 Grazing – Land And Animal Feed Resources (Import and Export of Animal Feed Resources) (Amendment) GN. NO.328 (Contd.) the certificate or permit shall, with effect from the date of suspension of the certificate- (a) stop to import or export; and (b) rectify the terms pursuant direction conditions Director’s recommendations within a given time. and to or and (4) Subject to compliance with the holder of subregulation (3)(b), certificate or permit shall continue with importation or exportation of animal feed resources product after receiving written permission from the Director. (5) Where the holder of a certificate or permit fails to comply with subregulation (3)(b) the Director of shall cancel registration or permit of import or export of animal feed resources. the certificate

20B.-(1) Any person aggrieved by the decision of the Director under these Regulations shall have the right to appeal to the Minister in writing within thirty days from the date of the decision of the Director. Appeal (2) An appeal under subregulation (1) shall be filed to the Minister accompanied with a copy of the Director’s decision. (3) The Minister may, within thirty days of receiving the appeal under subregulation (1), consider the matter and may- (a) affirm the decision of the Director; (b) require revise the Director or review to his 2 Grazing – Land And Animal Feed Resources (Import and Export of Animal Feed Resources) (Amendment) GN. NO.328 (Contd.) decision; or (c) order appellant to re-apply for registration of animal feed resource. (4) The decision of the Minister may be subjected to review by the court.".
