This section says the Act may be cited as the Evidence Act. This Act applies to judicial proceedings in all courts except primary courts when evidence is or may be given, but it does not apply to affidavits or arbitration proceedings. This section defines key terms used in the Act and sets proof standards for criminal and civil matters. If a law allows the court to presume a fact, the court may treat it as proved unless disproved or require proof of it. If this Act or another written law says the court must presume a fact, the court must treat that fact as proved unless it is disproved.
