Statute overview

About this statute

This section gives the Act its short title: the Judgements Extension Act. Certain foreign or Zanzibar decrees may be transferred to the High Court of Tanzania or subordinate courts for execution in Mainland Tanzania. Judges of the High Court or magistrates of subordinate courts may endorse and execute certain civil arrest warrants, or issue a provisional arrest warrant first, but only subject to the stated indemnity condition. A judge or magistrate who seeks a defendant’s arrest under a similar law and contacts a court in Kenya, Uganda, Malawi, or Zanzibar must first take security from the plaintiff and indemnify the court for costs and expenses. The High Court may prescribe the fees for any process or proceeding under this Act, but only with the Minister responsible for legal affairs’ approval.
