About this statute

This section gives the Act’s short title: the Occupiers Liability Act. This section says the Act replaces common law rules for occupiers’ duties to visitors and extends similar rules to people controlling certain structures and premises. An occupier must take reasonable care to keep visitors reasonably safe, subject to limited exceptions and any duty adjustments by agreement or otherwise. An occupier who is contractually allowing strangers onto premises cannot use the contract to cut down the duty of care owed to them, and the contract may also have to include extra performance obligations in some cases. A landlord can owe visitors and goods on the premises the same duty as an occupier where the landlord has a repair or maintenance obligation under the tenancy.
