About this statute

This provision gives the Act its short title: the Graves (Removal) Act. This section defines key terms used in the Act and indicates that the Minister has power to cause graves to be removed. If land with a grave is needed for a public purpose, the Minister may order the grave and buried body removed, and must arrange reinstatement and re-interment in a place he approves. If the Minister wants to remove a grave or dead body from land needed for a public purpose, the Minister must give notice first; in urgent cases, the President may change or waive the notice process. Notices under section 4 must include specified information about the land, inspection address, burial/re-interment details, and the person interested’s rights to object or notify the Minister.
