About this statute

This Act may be cited as the Evidence Act. This Act applies to judicial proceedings in all courts other than primary courts where evidence is or may be given, but it does not apply to affidavits or arbitration proceedings. This section defines key terms used in the Act, including confession, court, document, evidence, fact, oral evidence, police officer, relevant, and when a fact is treated as proved. When the Act or another written law allows the court to presume a fact, the court may treat it as proved unless disproved, or ask for proof. If a written law says the court must presume a fact, the court must treat that fact as proved unless it is disproved.
