司法院組織法

This provision states that the Act is enacted under Article 82 of the Constitution.

司法院各廳、各處要各設一名廳長或處長及一名副職；其餘工作人員應在本法定員額內派充。

司法院設參事六人至八人，負責法案、命令的撰擬與審核，以及提供法制意見和其他交辦事項。

司法院 must provide the listed staffing positions at the stated grade ranges, and certain existing employees without civil service appointment qualifications may keep filling clerk vacancies until they leave.

司法院得因業務需要，調各級法院法官到司法院辦理行政事項；也得因大法官審理案件需要，調實任法官到司法院，協助案件審查、法律問題分析、裁判書草擬及其他交辦事項。

司法院應設置 15 至 60 名大法官助理，並由司法院決定其遴聘、訓練、業務、管理與考核等事項。

司法院設人事處、會計處、統計處及政風處；這些處室依法律規定分別辦理各自的業務，並應在法定員額內派充所需人員。

各廳、處可因業務需要分科辦事；各科在必要時可再分股，且部分股長、科長可由指定職務兼任，並不另列等級。

司法院院長得召開司法院會議以研商重要事項；會議規則由司法院訂定。

司法院可因業務需要在院內設置各種委員會；委員及所需工作人員由院長從所屬人員中指派兼任。

司法院應設立法官學院；其組織另由法律規定。

司法院行使憲法所賦予的職權。

司法院得因保存、陳列司法文物需要設立司法博物館，並由司法院訂定其組織規程。

司法院有權訂定司法院處務規程。

This provision says the Act takes effect on the day it is promulgated, and the amended provisions also take effect on promulgation day, except that the amended Articles 3, 9, and 16 from the 2019-12-10 amendment take effect on 2022-01-04.

司法院設置15名大法官，並依法成立憲法法庭行使職權。

大法官必須符合列出的六種資格之一；符合前項任一資格的大法官人數不得超過總名額的三分之一。

大法官須超出黨派以外，獨立行使職權，且不得受任何干涉。

司法院設各級法院、行政法院及懲戒法院；其組織另由法律規定。

司法院院長負責綜理院務並監督所屬機關；院長或副院長出缺、不能視事時，另有代理規則。

The Judicial Yuan has one Secretary-General and one Deputy Secretary-General. The Secretary-General handles Judicial Yuan affairs under the President’s instructions and supervises staff; the Deputy Secretary-General assists the Secretary-General.

司法院設置若干廳、處，負責辦理本院行使職權的相關事項。
