總統副總統文物管理條例

This provision states the purpose of the law: to properly preserve, maintain, and manage presidential and vice-presidential artifacts, and to protect their state-owned property rights.

This provision says the regulation takes effect on the date it is published.

The National History Museum is the competent authority for this条例.

本條文定義「文物」：指總統、副總統因各項活動產生、且不屬於檔案性質的各種文字、非文字資料或物品。

總統、副總統任職期間，應將其所有文物交由國史館管理；政府機關或機構所有且具保存價值的相關文物也應交由國史館管理。

一般性文物要編造移轉目錄並定期由國史館具領；具機密性的文物要用專用封套密封、標註資料，並每年移轉國史館原樣典藏。

國史館所管理之總統、副總統文物，應定期編製目錄，並公開於資訊網路，或刊登於政府公報及新聞紙。

主管機關得依總統、副總統文物的類別及保存價值，進行分類與分級管理。

主管機關要先評估總統、副總統文物是否不符典藏效益；如是，應制定註銷計畫並送委員會審定。

國史館管理的總統、副總統文物，原則上應開放供各界使用；要閱覽、抄錄或複製者，應書面向國史館提出並說明理由。

主管機關可以把總統、副總統文物的管理及應用，委任所屬機關或委託其他機關（構）辦理。

Former presidents and vice presidents are also subject to this Act’s provisions.

主管機關可以訂定本條例的施行細則。
