檔案法

This provision states that the law is enacted to improve government agency archive management, promote archive openness and use, and strengthen archive functions. It also says that where the law does not provide otherwise, other legal rules apply.

檔案保存年限應依檔案的性質及價值，區分為永久保存或定期保存。

永久保存的機關檔案，應移交給中央主管機關管理；其移轉辦法由中央主管機關擬訂，並報請行政院核定。

各機關銷毀檔案前，先提出銷毀計畫和檔案目錄送中央主管機關審核；相關保存年限與銷毀辦法由中央主管機關擬訂，報請行政院核定。

公務員在交接職務或離職時，必須把其保管的文件一起辦理移交，並保持完整，不得隱匿、銷毀或藉故遺失。

對於具有永久保存價值的私人或團體文件、資料，檔案中央主管機關可以接受捐贈、受託保管或收購；捐贈者也可以獲得獎勵。

各機關如認為有保存必要，可以請求提供私人或團體所有的文字或非文字資料，並可用微縮或其他複製方式編成檔案。

The central archives authority determines the management methods for confidential files, after reporting to the Executive Yuan.

申請閱覽、抄錄或複製檔案時，應書面說明理由；各機關沒有法律依據不得拒絕。

各機關可以拒絕前條申請，但前提是檔案涉及特定敏感資訊或保密義務。

各機關要在受理後30日內，以書面通知申請人第十七條申請案件的准駁結果；如果駁回，還要說明理由。

This article defines four terms: government agency, archive, national archives, and agency archives.

閱覽或抄錄檔案，必須在各機關指定的時間和地點進行，且不得以列舉方式損壞或變更檔案。

If an application to inspect, copy, or transcribe files is approved, agencies may charge a fee under standards set by the central archives authority.

國家檔案原則上最遲應在三十年內開放應用；有特殊情形時，期限可經立法院同意延長。

違反第5條、未經核准把檔案運到國外的人，會被處罰；未遂也罰。

Knowingly destroying files that should not be destroyed, or destroying files in violation of the Article 12 destruction procedure or Article 13, is punishable by up to 2 years’ imprisonment, detention, or a fine of up to NT$50,000, or both.

Records stored by microfilm or other methods, and their copies, are treated as documents for certain criminal offenses.

If someone violates Article 20, agencies may stop access or copying. If the matter involves criminal liability, it must be referred to the competent prosecutor for investigation.

If an agency’s archives management does not comply with this Act or rules made under it, the agency must adjust it within the deadline set by the central archives authority.

公立大專校院、公營事業機構，以及受政府委託行使公權力者，在其受託事務範圍內，適用本法規定。

本法的施行細則由檔案中央主管機關訂定。

檔案事項由行政院設置的專責中央主管機關掌理；在該機關未設立前，由行政院指定所屬機關辦理。

本法的施行日期由行政院决定。

各機關管理檔案時，應設置或指定專責單位或人員，並編列年度計畫及預算。

檔案未經主管機關依法核准，不得運往國外。

檔案管理原則上採統一規劃、集中管理；檔案中的特定器物可交由有關機構保管。
