振興經濟擴大公共建設特別條例

This provision states the law’s purpose and says that matters not covered by it are governed by other laws.

中央教育主管機關可以擬訂擴大公共建設投資的專案計畫；相關特別預算經費在年度未執行完畢時，可以保留到後續年度使用，但未發生契約責任者，每年最長只能保留三年。

執行機關辦理本條例下的各項擴大公共建設投資計畫時，應依政府採購法相關規定辦理。

審計機關應依法審計本條例所列預算；若在審核擴大公共建設投資計畫時發現因公務人員違法失職致工程進度未達80%，應將執行機關首長及相關主管移送監察院調查懲處。

在涉及都市計畫擬定或變更時，必要時可由上級政府依都市計畫法第27條第2項直接變更。

各級區域計畫主管機關在審查土地變更申請案時，可以和水土保持、環境保護主管機關併行審查。

This provision says that when the statute’s implementation period ends, funding needed for any unfinished part of the expanded public construction investment plan must be handled through the annual general budget bill.

During the regulation’s implementation period, the amount budgeted in the central government general budget for major public construction projects must maintain appropriate growth.

This provision applies from the publication date until 31 December 2012.

This provision names the central, central-executing, and local executing authorities, and says indigenous-area public construction is carried out by the central indigenous affairs authority, which may delegate to another agency when necessary.

This provision assigns planning, review, implementation, budgeting, and funding allocation roles for expanded public construction investment plans among central and local agencies.

This provision defines an “expanded public construction investment plan,” requires its investment items to satisfy at least one listed principle, limits recurring spending to no more than half of capital spending for government-led plans, and directs the central government to prioritize project funding already approved before the Act took effect.

本條規定本條例經費上限為新臺幣五千億元，並可編列為特別預算；教育部也可依本條例擬訂就學安定計畫。

中央執行機關辦理擴大公共建設投資計畫時，必須完整規劃並在需要時辦理環境影響評估，還要準備相關報告送行政院核定。

中央執行機關要依核定事項做細部設計並按期分年提報經費需求；中央主管機關要審查申請、分配經費並排列優先順序，最後提報行政院。

行政院 must prepare the annual special budget proposal under this Act, attach the required documents and reports, and submit it to the Legislative Yuan for review.

各機關執行本條例特別預算時，應依預算執行程序辦理；未執行部分要依預算法解繳國庫，且不得移用。
