傳染病流行疫情嚴重期間司法程序特別條例

This provision states that, during a severe infectious disease outbreak, the statute is enacted to keep judicial proceedings effective, protect parties’ right to a prompt and fair trial, and safeguard participants’ health and safety.

法院在民事或家事事件中，符合條件時可以裁定停止程序；停止原因消失後，也可以撤銷該停止裁定。

Documents for judicial duties may be submitted or served by fax or other technology equipment, according to the rules for administrative litigation document use.

法院在特定案件中，如認為程序繼續進行有重大困難，得在徵詢相關人意見並審酌情況後，依聲請或依職權裁定停止程序。

本條例自公布日起施行，並在中華民國一百十二年六月三十日止；期滿後，可經立法院同意延長。

法院在符合指定公開審理相關規定時，可以採取必要應變措施、在管轄區域外臨時開庭，並可用視聽科技宣示裁判。

在符合條件時，法院、少年法院，以及司法警察官或司法警察可以用聲音及影像傳送設備進行訊問、陳述或程序，並可不受相關規定限制。

本條規定法院、當事人等可在一定條件下用傳真或電子郵件傳送文書，並規定送達何時生效。

A transcript may be completed later based on an audio recording made at the scene, and the recording must be backed up immediately.

法院在刑事案件中，符合特定情況時可以停止審判；原因消滅後，法院應繼續審判，當事人也可以聲請繼續審判。

If the parties or related persons have suitable audio-video technology connecting them with the court, the court may conduct the hearing using that equipment when it considers it appropriate.
