司法院釋字第七四八號解釋施行法

本法是為了落實司法院釋字第七四八號解釋的施行而制定。

This provision says that when a second-marriage relationship is revoked, or when such a relationship is invalid or revoked, the Civil Code rules cited in the article apply to the relevant matters.

雙方當事人互相負有同居義務；如果有不能同居的正當理由，則不受此限。

雙方當事人先共同協議住所；如果沒有協議或協議不成，可以聲請法院決定。

This provision says the two parties act as each other’s agents for daily household matters, and if one abuses that agency power, the other may restrict it, but not against a good-faith third party.

雙方當事人原則上要分擔家庭生活費用，並就因該費用產生的債務負連帶責任；但法律或契約另有約定的，從其約定。

雙方當事人的財產制，適用民法親屬編第二章第四節關於夫妻財產制的規定。

雙方當事人可以合意終止第二條關係，但終止必須以書面為之，並有二人以上證人簽名，且要向戶政機關辦理終止登記。

一方在法定事由或重大事由下，可以向法院請求終止第二條關係；但部分事由有同意、宥恕與期間限制，逾期就不能請求。

如果第二條關係的終止經法院調解或法院和解成立，該關係即消滅；法院並應依職權通知主管戶政機關。

When a relationship ends, the Civil Code rules apply to decisions on child custody and guardianship, damages, alimony, and return of property.

相同性別之二人得為經營共同生活的目的，成立具有親密性及排他性的永久結合關係。

When one spouse adopts the other spouse’s child, or when the spouses jointly adopt, the Civil Code rules on adoption apply.

Article 21 says the rules in Civil Code Articles 1111 to 1111-2 about spouses apply mutatis mutandis to both parties in an Article 2 relationship.

第二條關係雙方當事人互相負有扶養義務。

第二條關係雙方當事人有相互繼承的權利，並可準用民法繼承編關於繼承人及配偶的規定。

Provisions about spouses, marriage, and related spousal relations in the Civil Code and other laws apply mutatis mutandis to the relationship in Article 2, unless this Act or other regulations say otherwise.

因第二條關係所生的爭議，屬於家事事件，並適用家事事件法的相關規定。

本法施行不影響任何人或團體依法享有的宗教自由及其他自由權利。

本條列出本法、修正條文，以及特定修正條文的施行日期。

未滿十八歲者不得成立前條關係。

成立第二條關係要用書面，且要有二名以上證人簽名；雙方當事人還要依本法及司法院釋字第七四八號解釋，向戶政機關辦理結婚登記。

同一性別的特定親屬之間，不得成立第二條關係。

在監護關係存續中，相同性別的監護人與受監護人不得成立第二條關係；但經受監護人父母同意者，不受此限制。

已結婚或已成立第二條關係的人，不得再成立第二條關係；一人也不得同時與二人以上成立第二條關係，或同時涉及結婚與第二條關係；已成立第二條關係者也不得再結婚。

A relationship is invalid if it lacks the required form, violates Article 5, or violates Paragraph 1 or 2 of the preceding article. A marriage is also invalid if it violates Paragraph 3 of the preceding article.

符合條件的人可以向法院請求撤銷第二條關係；但成年後的當事人，或第二條關係成立已逾一年者，不得請求撤銷。
