民事訴訟費用法

The collection and calculation of civil litigation costs are governed by this Act.

If a dispute concerns debt security, the secured debt amount is the benchmark; if the collateral is worth less than the debt, the collateral’s value is used instead.

For litigation about redemption of pledged property, the property price is the basis; if the dispute is only about the pawn price, the plaintiff’s claimed benefit is the basis.

In water-conservancy litigation, the standard is the amount of expected increase in annual water-conservancy收益.

For lawsuits involving lease rights, the amount is based on the total rent over the lease term; if that total exceeds the leased property’s value, the property value is used instead; if there is no fixed term, the amount is based on two periods’ rent.

涉及定期給付或定期收益的訴訟，應以權利存續期間的收入總數為準；如果存續期間不確定，則推定其期間。

If the lawsuit subject matter value cannot be determined, it is treated as 500 yuan.

民事非財產權訴訟要徵收裁判費四十元；如果同時有非財產權之訴與財產權請求，裁判費分別徵收。

If the main claim and the counterclaim have the same subject matter, no additional court fee is charged for the counterclaim.

民事案件向第二審或第三審法院上訴時，要依規定加徵裁判費十分之五；但發回或發交更審後再上訴的，不用加徵。

Civil retrial cases pay court fees according to the court level and the rules in Article 2, Article 16, and the preceding article.

財產權民事起訴案件的裁判費，訴訟標的未滿一百元免徵；一百元以上者按每百元徵收一元，不足百元部分視為百元。

Civil appeals are charged a court fee of 10 yuan; the same applies to a re-appeal.

Civil applications or statements are generally exempt from fees, but the listed applications must pay a court fee of 10 yuan.

各高等法院應依地方交通與生活情形，訂定推事、書記官出外調查證據及執達員送達文書之食、宿、舟、車費標準，並報請司法院核准後施行。

高等法院可在必要或經濟情形下，報請司法院核准後，調高部分法院費用；裁判費加徵額不得超過原額數的五成，抄錄費等可提高至十倍。

訴訟標的的價額，依本法第4條至第15條計算。

無力支付訴訟費用並聲請訴訟救助的人，可以由受訴法院管轄區域內有資力的人出具保證書，代替對事由的釋明。

This provision says the law takes effect on the date it is promulgated.

法院核定訴訟標的的價額；原則上以起訴時的交易價額計算，沒有交易價額時則以原告對訴訟標的的利益為準。

If one lawsuit claims multiple items, their value is added together. But interest, other fruits, damages, liquidated damages, and costs are not included in the value.

If multiple claims in one lawsuit conflict or are alternative to each other, the value of the litigation object is determined by the highest value among them.

原告負擔的對待給付，不得從訴訟標的價額中扣除。

A disputed land ownership or perpetual leasehold case is valued at 15 times one year’s rent; if there is no rent, use 15 times the yearly benefit; if that exceeds the land price, use the land price instead.

地役權訴訟中，原告是地役權人時，以需役地增加的價額為準；原告是供役地人時，以供役地減少的價額為準。
