If a debtor cannot pay debts, the debts are handled through the composition or bankruptcy procedures provided by this law. If the debtor stops paying, that is presumed to mean the debtor cannot pay.

About this statute

If a bankruptcy claim is not yet due, it is treated as due when bankruptcy is declared. If a claim becomes due only after a bankruptcy declaration and bears no interest, the claim amount must be reduced by statutory interest from the bankruptcy declaration date until the due date. A contingent claim may be treated as a bankruptcy claim for its full amount. The listed claims are not bankruptcy claims. If multiple persons are liable for the same obligation and all or some are declared bankrupt, the creditor may exercise its rights against each bankruptcy estate for the full amount of the claim.
