妨害國家總動員懲罰暫行條例

Anyone who violates or obstructs national mobilization laws, regulations, or business is subject to punishment under this statute.

違反依國家總動員法第二十二條所發命令的人，依出版法處罰；必要時，刑罰可加重至二分之一。

洩漏或盜用國家總動員業務相關秘密者，處三年以下有期徒刑；公務員在從事國家總動員業務時犯前項之罪者，處六月以上五年以下有期徒刑。

受政府委託執行國家總動員業務的人，若犯本條例之罪，視同公務員。

公務員假借職權，利用國家總動員機會發布命令致人受損害者，處三年以上十年以下有期徒刑；情節重大者，處死刑或無期徒刑。

Public servants who shield someone committing an offense under this ordinance are punished under the relevant ordinance, with the penalty increased by up to one-half.

This provision says the条例 takes effect on the date it is promulgated.

本條規定：如果本條例公布前已施行的經濟管制法令有較重處罰，就依那些規定。

犯本條例之罪者，軍人由軍事機關審理，非軍人由司法機關審理。

涉及管制動員物資及業務的案件，原則上依其他法令既定的審判機關與程序辦理；但在情節重大且有特殊必要時，國家總動員會議得決定改由有軍法審判權的機關審判。

Anyone who violates or obstructs the listed orders is subject to up to 7 years’ imprisonment and may also be fined up to 7,000 yuan.

If any of the listed violations occurs, the offender is punishable by up to 3 years’ imprisonment and may also receive a fine of up to 3,000 yuan.

If an offense under the previous two articles seriously harms military or public security, or thereby disrupts finance, the offender faces death or life imprisonment, and property may also be confiscated.

違反本條列舉的檢查或命令者，可能被判處一年以下有期徒刑、拘役，或一千元以下罰金。

Anyone who commits one of the listed acts is punishable by imprisonment up to six months, detention, or a fine up to 500 yuan.
