This provision defines “赦免” as including general amnesty, special amnesty, commutation, and restoration of rights. This provision states two effects of amnesty: any criminal sentence already declared becomes void, and any case not yet sentenced loses the right to prosecute. A person pardoned after conviction is exempt from execution of the punishment. 經減刑的受罪刑宣告之人,其原宣告的刑罰會減輕。 因罪刑宣告而喪失的公職,若在大赦或依第三條後段特赦後有向將來回復的可能,當事人可以向主管機關申請回復。
