中華民國六十年罪犯減刑條例

This provision states the law’s purpose: to commemorate the Republic of China’s 60th year and give offenders an opportunity to improve.

Time already served before sentence reduction is credited toward the reduced sentence, but any excess beyond the reduced sentence is not counted. Amounts of fines already paid are also credited toward the reduced fine, with any excess not counted.

This provision says the statute takes effect on October 10, ROC year 60.

Crimes committed before 1961-08-16 are eligible for sentence reduction, except the listed offenses.

For eligible persons whose conviction is final but the sentence has not yet been fully carried out, the punishment must be reduced under the listed rules.

For cases eligible for sentence reduction under this law that have not yet become final, the rule in the preceding article’s first paragraph is applied when the court decides the case.

For offenses eligible for sentence reduction, deprivation of public rights is considered using the same standards as the reduced main punishment.

保安處分不適用本條例的規定。

符合第三條減刑的案件，由檢察官、軍事檢察官、最後審理事實的法院或軍事審判機關在有人聲請後裁定。

If several crimes were committed before final judgment and sentence reduction is required, the sentence is reduced for each crime and then the total sentence is determined under Criminal Code Article 51. If an aggregate sentence has already been set, it is still redetermined under the preceding rule. The same applies to residual offences under Article 54 when they are all subject to reduction.

裁判確定前犯數罪，若其中有些罪應減刑、其他罪不應減刑，應先依第三條、第四條及前條對應減刑後，再依刑法第五十一條定應執行之刑。
