公設辯護人條例

高等法院以下各級法院及其分院應設置公設辯護人。

This provision sets rank levels for public defenders at district and high courts and allows advancement to higher ranks if service, performance, and review conditions are met.

公設辯護人的俸給，依照法官、檢察官的俸給標準核給。

公設辯護人對法院及檢察官獨立行使職務。

公設辯護人對法院指定案件負有辯護責任，並應盡量蒐集有利被告的辯護資料。

公設辯護人對其承辦案件負有誠實處理的責任。

公設辯護人應製作訴訟進行情形及其他有關訴訟事項的紀錄。

Public defenders must prepare a defense brief for designated defense cases and submit it to the court.

If a public defender case is appealed, the public defender must prepare the appeal statement or response brief at the defendant’s request.

公設辯護人應將與訴訟有關的文書編成卷宗。

公設辯護人就承辦案件應按月製作月報表，並由該管法院院長轉報司法院；月報表格式由司法院決定。

In criminal cases, a defendant may ask the court to appoint a public defender, but if a public defender has already been appointed under Article 31(1), that request is excluded. If the defendant lacks funds to hire counsel, the court must appoint one. The court may also appoint a lawyer when necessary and pay a fee.

公設辯護人應在蒐集辯護資料時互相協助。

法院組織法第110條、第112條、第113條的規定，適用於公設辯護人。

公設辯護人在執行職務時，不受前條規定影響。

在最高法院命行辯論的案件中，無資力且不能依刑事訴訟法第389條第2項選任辯護人的被告，可以聲請最高法院指定下級法院公設辯護人為其辯護。

公設辯護人不得充任選任辯護人。

公設辯護人不得收受被告任何報酬。

公設辯護人必須在所屬法院管轄區域內執行職務。

地方法院及其分院只能任用符合列舉資格之一的人擔任公設辯護人；司法院負責訂定公設辯護人管理規則。

This provision sets eligibility requirements for appointing principal and ordinary public defenders in district courts and high courts, based on prior service years and good performance.

If there are two or more public defenders, one is designated as the chief public defender to supervise and assign public defense matters.
