刑事案件確定後去氧核醣核酸鑑定條例

This provision states the purpose of the条例 and says that where it does not provide a rule, other relevant laws apply.

本條例自公布日起施行。

符合特定條件者，得聲請對相關證物或檢體進行 DNA 鑑定。

就前條提出的聲請，由作成判決的第一審法院管轄。

第2條的聲請，可以由受判決人本人、其法定代理人或配偶提出；如果受判決人已死亡，還可以由其配偶、一定範圍內的血親、姻親、家長或家屬提出。

依第二條提出聲請時，應以書狀載明具體理由及鑑定方法或技術，並向管轄法院提出。

If the court considers it necessary, it may carry out an appropriate investigation into the matters in Article 2 and notify the applicant and defense counsel to appear and state their opinions.

法院可駁回不合法或無理由的聲請；若程序缺漏可補正，先命補正。聲請有理由時，法院應裁定准許鑑定。

法院在鑑定結果對聲請人有利時，應命鑑定機關把鑑定結果送交去氧核醣核酸資料庫主管機關，並由主管機關進行比對。

偵查機關處理證物及檢體時，應妥善採取、保管並移轉，以確保其正確無誤。
