縣參議會組織條例

The county council is the representative body for the county’s people.

縣參議會議長、副議長各一人，由縣參議員以無記名投票互選；若縣長或副議長因事故去職，依前項方式補選。

縣參議會每三個月開會一次，每次會期為三日至七日；必要時可以延長會期。

County council meetings are convened by the speaker, and the first meeting is convened by the county magistrate.

縣參議會開會時，由議長主持；如果議長和副議長都有事故，則由參議員互推一人擔任臨時主席。

縣參議會開會需要全體參議員過半數出席；議案以出席參議員過半數同意通過，票數相同時由主席決定。

縣參議員不得就與自己有利害關係的議案參與表決。

縣參議會開會時，可以請縣長、縣政府秘書科長或其他負責職員到場報告或說明。

縣參議會會議原則上公開；但在主席或三名以上參議員提議，並經會議通過時，可以禁止旁聽。

縣參議員是無給職；開會期間可依地方情形酌給膳宿及交通費。

縣參議員在會議中的言論和表決，對外不負責任。

This provision lists the county council’s powers and requires certain budgets, regulations, and final accounts to be reported to the provincial government for record.

縣參議員在會期內，除現行犯外，未經縣參議會許可，不得逮捕或拘禁他人。

縣長要執行縣參議會的決議；若延不執行或執行不當，縣參議會可以要求說明，還可以再報請省政府核辦。

縣長如認為縣參議會的決議案不當，得附理由送請覆議；若對覆議結果仍認為不當，得呈請省政府核辦。

省政府在認為縣參議會決議違反三民主義或國策時，得經說明事實並報請行政院核准後，將其解散並重選。

縣參議會應設秘書一人，事務員和書記各一至五人；秘書由目政府遴委，事務員和書記由議長派充。

縣參議會在開會期間，可以調用縣政府的人員。

縣參議會的議事規則由內政部訂定。

The organization of a provincial municipality city council follows the provisions of this Act by analogy.

This provision sets how county councillors are allocated: one per township generally, seven councillors for counties with fewer than seven townships, and occupational-group elections may not exceed three-tenths of the total.

A county councillor who is present for all meetings in one session and has no justifiable reason is deemed to have resigned, and a substitute elected candidate fills the vacancy.
