立法院立法委員選舉罷免法施行條例

This provision says the regulation is made under Article 47 of the Legislative Yuan Election and Recall Act.

軍隊服役且有選舉權的人，應向其本籍主管選舉機關辦理選舉人登記；前一項辦法也準用於長警。

選舉人名冊公告期間為五日；本人如認為有錯誤或遺漏，得在公告期間請求更正。

在選舉人名冊公告確定後，主管選舉機關應於選舉三十日前製發選舉權證，以供領取選舉票。

選舉人名冊公告後六日內，主管選舉機關應公告候選人開始登記；該公告並須列出指定法條全文。

Candidates with the right to be elected must register in person with the competent election authority after signing the required documents.

Certain people may apply to register as candidates for their native-place election.

選舉人對候選人登記的簽署只能算一次；重複簽署要補正且不計入，候選人冒用他人名義簽署會使登記無效，若選後才發現且判決確定，當選也無效。

候選人名單應依登記先後排序。

在軍隊服役且不能回籍投票的有選舉權人，可以在軍隊所在地，依本籍公布的候選人名單投票；具體辦法由選舉總事務所訂定。

每一有被選舉權人只能登記一種候選人登記；若同時登記兩個以上，登記無效且不得當選。

符合條件的中華民國國民，在該選舉區內有選舉權及被選舉權。

The central election office sets the organization regulations for election offices other than itself.

Provincial district election offices must have their order arranged by number.

主管選舉機關派充投票與開票管理、監察人員後，應造具名冊並報上級機關備案。

上級選舉機關要訂定各選舉事務所、投票所及開票所的辦事細則，並報選舉總事務所備案。

主管選舉機關要依各投票所選舉人人數製作投票簿，記載選舉人基本資料，並在投票前交給投票管理員保管；必要時，投票簿可用選舉人名冊代替。

投票管理員 must 維持投票秩序，掌管投票匭、投票簿及選舉人名冊，並辦理選舉機關委任的其他事項。

開票管理員必須維持開票秩序、清點投票數和得票數、保存選舉票，並辦理選舉機關委任的其他事項。

投票監察員和開票監察員分別監察投票、開票事宜；如與管理員有不同意見，應報請主管選舉機關決定。

Election commissioners, supervisors, and staff may not be candidates for legislator in the area or organization where they handle elections.

Election general affairs office staff at all levels may not be legislative yuan candidates.

This provision limits the matters referred to in Article 6, items 5 and 6 to cases proven by a physician registered according to law.

第四條各款選舉應在三日內辦理完竣。

Election officials must order a voter to leave if the voter is impersonating someone, is registered multiple times, is noisy or persuading others and refuses to stop, brings weapons into the polling place, or otherwise misbehaves and refuses to stop.

If a voter is ordered to leave under the previous article, the ballot must be taken back and the reason must be noted in the voting register under that voter’s name.

投票和開票時間不得在上午八時前、下午八時後；未完成投票或開票的票匭，應先由管理員會同監察員暫時封鎖，次日續行時再當眾驗明啟封。

Election officials must set and announce the ballot-counting time by the day after all ballot boxes arrive, then attend the counting place and supervise a public count.

選舉人可以請求開票管理員提供入場券，進入開票所參觀開票事宜，但以座位未滿為限。

開票管理員在開票時，應會同開票監察員認定選舉票是否作廢，並在認定後當眾宣布。

The ballot register and tally record must be copied, and their originals must be kept for three years.

各主管選舉機關在選舉結束後，應製作載明選舉情形與選舉結果的報告書，並呈報上級選舉機關備案。

If two or more elected persons or alternates receive the same number of votes, their ranking is decided by lot.

每位選舉人只有一個選舉權；主管選舉機關在查對選舉人名冊時，若發現同一選舉人有兩個以上選舉權，應要求其自行選定一種，並通知有關機關備查。

If a candidate is elected in the elections covered by Article 4, item 2 or above, those election results are invalid.

This provision defines “ethnic groups in border areas” and requires the election authority to handle their voter lists and vote counts separately, then report and publish the results.

選舉辦理完竣後，主管選舉機關或指定公告機關應在10日內公告當選人名單、報告上級選舉機關，並通知當選人提交兩張最近二寸半身照片。

This provision says the election affairs office must prepare and send the legislator election certificate to the relevant superior election authority, which must attach two photos, stamp and issue the certificate, stamp the photo, and file the stub with the competent election authorities; if that superior authority is the election affairs office, the competent election authority issues it after stamping.

立法委員的當選證書遺失或毀滅時，可以依規定申請補發。

If an election certificate is lost, a request for reissue should be made within one month after the loss is discovered.

When an elected person’s seat becomes vacant for cause, the substitute candidate fills it in order.

立法委員當選後，須攜帶當選證書親自到立法院報到。

If the election was conducted in violation of law or involved election fraud affecting at least one-tenth of the voter register, a voter or candidate may file an election lawsuit; if the judgment becomes final, the election is invalid and must be rerun.

If an election result is finally invalidated by judgment and the certificate has already been issued, the election authority must order its return and handle the cancellation of replacement procedures according to law.

參加選舉的職業團體，限於已依法向主管機關立案者；未完成立案的，主管機關得依法審查資格、編造名冊並呈准參加選舉。

主管行政機關首長查明罷免聲請書簽署人不實時，應立即剔除；如果剔除後不足法定名額，該罷免聲請書作廢。

When a copy of a recall petition is served on the recalled person, proof must be by postal receipt or delivery receipt.

被聲請罷免人應在收到罷免聲請書副本後15日內提出答辯書；答辯期間最長30日。

如果因郵遞遲滯而逾期到達，答辯書得在投票日前補行公告；投票日期仍按罷免聲請書公告之日計算，且須在三十日內辦理。

If a recall motion passes, the competent administrative authority must require the recalled person to return the certificate of election and promptly handle the cancellation and replacement procedures.
