監察院監察委員選舉罷免法

監察院監察委員的選舉與罷免，依憲法及本法辦理。

This provision sets how provincial supervisory commissioners are elected, including separate counting for female candidates, leaving a seat vacant in certain female-candidate cases, and using a tie-break lottery when votes are equal.

每省市議會議員當選為監察委員者，限為一名。

監察委員當選後，由各省市、蒙古、西藏及華僑團體的選舉監督分別發給當選證書，並向國民政府申報。

繼任監察委員的補選日期由命令決定；繼任者任職到原任期屆滿日為止。

不得對就任未滿六個月的監察委員提出罷免聲請。

選舉人達四分之一以上時，可以連署提出對所選出監察委員的罷免聲請書。

罷免申請書應說明理由，並送達指定的議長或首長。

議長或首長在收到聲請書後30日內，應查明連署是否屬實及人數是否符合法定要求，並通知被聲請罷免的監察委員聲請書副本，且召集罷免會。

被聲請罷免的監察委員可以在收到前條通知後10日內提出答辯書，送交收受罷免聲請書的議長或首長；聲請書與答辯書要同時公布。

A recall motion is decided by secret ballot and passes only if more than half of the total votes cast are in favor.

本條規定監察委員由各指定議會、代表會和華僑團體分別選舉；在部分議會尚未正式成立前，改由準備程序指定的機關先行選出。

罷免案通過後，由議長或首長公告，並依法補選；補選出的監察委員任期到原任期屆滿日為止。

If a recall petition is rejected, the original petitioner may not file another recall petition against the same monitoring commissioner during the current term.

This provision says the law applies, before the provincial/city councils and Mongolian local councils are formally established, to the existing councils and representative assemblies named in the text.

If conduct in relation to elections or recalls also constitutes a criminal offence, it is dealt with under criminal law.

Implementation rules for this Act are to be separately prescribed.
