公職人員選舉罷免法

This provision states that elections and recalls of public officials are governed by this law.

各級選舉委員會在辦理選舉或罷免期間，可以調用各級政府職員辦理事務。

This provision criminalizes vote-buying and vote-selling in specified local elections, with imprisonment, possible fines, confiscation of the bribe, and reduced punishment for timely self-reporting.

政黨辦理黨內提名時，必須公告提名作業內容，並在公告後5日內報請內政部備查；相關提名期間內的特定行為，會按後引條文處罰。

散布與選舉或罷免有關的謠言、不實訊息，或用深度偽造內容供人觀看者，會有刑責；若意圖營利，刑度與罰金都會加重。

違反第五十條的中央及地方政府各級機關首長、其代理人或受其指示之人，可能處三年以下有期徒刑。

If a person violates the listed provisions or circumstances and is ordered to leave but does not leave, they can be punished with up to 2 years’ imprisonment, detention, or a fine up to NT$200,000.

Violating Article 65, paragraph 3 can result in a fine of NT$30,000 to NT$300,000. Violating Article 65, paragraph 4 can result in imprisonment of up to 5 years and an additional fine of up to NT$500,000.

During elections or recall proceedings, people who join in crowding around certain offices or residences, or who use force, coercion, or other unlawful means to obstruct campaign or recall activities, face criminal penalties.

A person who takes a ballot out of the polling place, or who shouts or interferes within 30 meters of the polling place and keeps doing so after being stopped, can be punished.

If someone intends to obstruct or disrupt voting or vote counting and then withholds, destroys, hides, swaps, or takes ballots or related election materials, they face imprisonment of up to five years.

各級選舉委員會負責辦理選舉、罷免相關事項；直轄市、縣（市）選舉委員會並可指揮、監督鄉（鎮、市、區）公所辦理特定選舉、罷免事務。

This provision sets fines for several election, recall, and broadcasting-related violations, including improper office registration, advertising rule breaches, failure to remove or stop content, and tampering with ballots.

對特定罪名的犯人，如果在一定時間內自首或在偵查、審判中自白，刑罰可以免除或減輕。

A recommending political party can be fined if its nominated candidate is finally convicted of listed offences; the same applies to certain party-nominated candidates and, in some cases, to offences against other candidates or party-nominated candidates.

Certain elected officials automatically lose office or authority from the judgment date if convicted of specified crimes and not granted a suspended sentence; if later acquitted before the term ends, they are restored.

Certain people may file an election or recall invalidity lawsuit within 15 days if unlawful election commission conduct could affect the result.

選舉或罷免無效之訴經法院判決確定無效後，該選舉或罷免即屬無效，並應定期重行辦理；若違法只涉及部分，則僅該部分無效，並就該部分定期重行投票。

If an election-invalidity lawsuit is finally upheld, the elected person’s election is void. If the person has already taken office, they must be removed from office from the date the judgment becomes final.

A judgment invalidating an election or a winner does not affect the winner’s acts performed after taking office.

符合特定情形時，選舉委員會、檢察官、被罷免人或提議領銜人可在投票結果公告後60日內，向管轄法院提起罷免案通過或否決無效之訴。

在選舉訴訟程序中，訴訟當事人或其訴訟代理人可以查閱、影印選舉票或選舉人名冊。

選舉委員會的年度經常費由中央政府統籌編列；各類選舉、罷免所需經費由指定的政府機關或公所編列。

選舉委員會負責處罰本法及相關條例所定的罰鍰；候選人或政黨經通知後逾期不繳時，選舉委員會得直接從其保證金或競選費用補助金中扣除。

修正施行前已發布選舉公告的選舉，或已向主管選舉委員會提出的罷免案，仍適用修正前規定。

中華民國國民年滿二十歲者，有選舉權。

在選舉區連續居住滿四個月以上的人，成為該選舉區的公職人員選舉人；選舉公告發布後才遷入的人，沒有投票權。

For elections of indigenous public officials, the electors are voters who have indigenous status and meet the qualifications in the preceding article.

除另有規定外，選舉人應在戶籍地投票所投票；投票所工作人員可在戶籍地或工作地投票所投票。

選舉人領票時要出示本人國民身分證，並在名冊上簽名、蓋章或按指印；原則上要自己圈投。

選舉人必須在規定投票時間內到投票所投票；逾時不得進入，但已在時間內到達且尚未投票者仍可投票。

When two or more public office elections are held on the same day, the voter register may be prepared separately or combined as needed.

選舉人名冊編造後，戶政機關要由鄉（鎮、市、區）公所函報選舉委員會備查，並公告供閱覽；選舉人可在閱覽期間到場查閱，發現錯誤或遺漏時可申請更正。

Certain election-related officials and staff must not campaign or promote or oppose recall matters after an election notice is published or a recall proposal is received.

選舉委員會通常要在競選期間舉辦公辦政見發表會，候選人要親自到場發表政見。

選舉委員會要編印選舉公報並公告，候選人和政黨也要在登記時交資料；部分資料若未附證明、屬不實或不符規定，則不得刊登。

The Central Election Commission must provide free TV airtime for registered parties in the named election, and TV stations may not refuse it. Individuals or groups may also hold national TV debates if enough registered parties agree.

在選舉或罷免期間，符合資格的人可以向警察機關申請對疑似深度偽造的聲音或影像進行鑑識；被通知的媒體、平台業者必須在二日內停止刊播或下架，並保存相關資料。

政黨及任何人發送或懸掛競選、罷免宣傳品時，須依規定署名、揭露部分身分資訊，且張貼與懸掛地點受限制；廣告物不得妨礙公共安全或交通秩序，並應在投票後七日內自行清除。

在選舉或罷免期間，發布民調資料時要載明指定資訊；在兩個禁止期間內，未依規定或具民調外觀的資料不得被發布、報導、散布、評論或引述，但特定參選者自行推估者除外。

政黨及任何人在從事競選或罷免活動並使用擴音器時，不得製造噪音。

本條禁止特定候選人、助選人及罷免相關人員發表煽惑他人犯罪、以暴動破壞社會秩序，或觸犯其他刑事法律的言論。

政黨及任何人不得在特定時段、投票日，或以特定方式妨害選舉／罷免活動，也不得邀請特定外國或港澳、大陸地區人士作為第四十五條所列行為；但有明列例外。

本條規定投票所的設置、無障礙協助、投開票程序、資料交付與票冊保管，並限制未持證者進入投票所及禁止一般人拆開選舉票。

選舉委員會要派任投票所、開票所的主任管理員和管理員；主任管理員必須是現任公教人員，管理員中至少三分之一也必須是現任公教人員。

投票所和開票所要配置主任監察員與監察員，監察員由候選人、政黨等依規定推薦，選舉委員會再審核派充。

Voters must mark one person on the ballot using the commission-prepared tool, but for certain legislative elections they mark one party instead.

Active-duty military personnel, active-duty replacement service personnel, and public servants may not be proposers of a recall proposal.

This article sets the filing periods for recall signature collections and requires the lead proposer to submit the signature sheets to the election commission within the applicable period.

A recall petition’s signatories must be voters from the recalled person’s original electoral district, and they must total at least 10% of that district’s voters.

本條規定：計算「選舉人總數」時，以被罷免人當選時原選舉區的選舉人總數為準；「選舉人」的年齡與居住期間，則以罷免案提出日為計算基準。

罷免案投票原則上應在宣告成立後20日至60日內舉行；若期間內有其他選舉，原則上可同時投票，但被罷免人同時是候選人時，則應在60日內單獨舉行。

投票人圈選後，不得把圈選內容給別人看。

罷免案的投票人、投票人名冊、投票與開票，適用本法關於選舉人、選舉人名冊、投票與開票的規定。

罷免案以有效同意票多於不同意票，且同意票達原選舉區選舉人總數四分之一以上為通過；否則為否決。

選舉委員會要在投票結束後7日內公告罷免結果；罷免通過後，被罷免人自公告日起解除職務。

在競選、助選或罷免機會中，公然聚眾以暴動破壞社會秩序者，會被處罰；首謀者處罰更重。未遂犯也處罰。

意圖妨害選舉或罷免，對依法執行職務的公務員施強暴或脅迫者，會受刑事處罰。

候選人或具候選人資格者若為放棄競選或特定競選活動而行求、期約、交付、要求或收受賄賂或其他不正利益，會受徒刑與罰金處罰；預備犯也有刑罰，相關賄賂還會被沒收。

Using violence, coercion, or other unlawful means to interfere with an election or recall petition activity is punishable by up to 5 years’ imprisonment; attempted conduct is also punishable.

以虛偽遷徙戶籍取得投票權而投票，或以同樣方式取得罷免案投票權而投票，處五年以下有期徒刑。
