市組織法

City self-governance follows the rules for county self-governance, except where this Act provides otherwise.

市政府設市長一人，負責統籌全市事務，並指揮監督所屬機關及職員。

市政府可設局或設科辦理民政、財政、教育、建設、警察、衛生等事項；是否設局或設科，由行政院依事務繁簡決定。

院轄市市政府設秘書長一人，省轄市市政府設秘書主任一人，負責文書庶務及其他不屬於各局科的事項。

院轄市市政府在必要時可以設置一至二名參事，負責規章撰擬事項。

市政府因業務需要，可以設置技術人員及視導人員。

This text lists several city government positions and the appointment grades associated with them.

市政府的人員編制和職務分配，要依各市人口多寡與事務繁簡，寫入市政府組織規程；該組織規程由行政院定。

市政府可以酌量雇用雇員。

市政府要設置主辦會計人員和主辦統計人員各一人，並共同決定會計統計所需佐理人員名額。

市政府應設置市政會議，並由指定人員組織。

行政院有權制定市自治實施辦法。

下列事項必須經市政會議議決。

市政會議每月至少開會一次，由市長召集，開會時由市長主持。

The meeting determines its own procedural rules.

市參議會由市公民和依法成立的職業團體選舉市參議員組成；其中由職業團體選出的參議員不得超過總額的三分之一。

City councillors elect the council president and vice president.

The organization, powers, and election method of the city council are to be determined by law.

市財政應依財政收支系統及相關法令辦理。

區民代表由保民大會選舉，每保二人，任期二年，且可連選連任；如違法或失職，保民大會得予罷免。

區代表會有權審議、議決、選舉或罷免區長副區長，並聽取區公所報告及提出詢問。

區民代表會應設主席一人，由代表互選產生；開會時，可以通知區長、保長列席。

符合列舉情形之一的人民聚居地方，設為市，並受行政院指揮監督。

The district representatives assembly must meet every three months, and the chair convenes the meeting. If necessary, an extraordinary meeting may be held.

區民代表會未達本區區民代表過半數出席時，不得開議；議案表決以出席代表過半數同意為準，票數相同時由主席決定。

區民代表會的決議案要送請區長分別執行；如果區長延不執行或執行不當，區民代表會可以要求說明理由，仍不滿意時可以報請市政府核辦。

區長如認為區民代表會的決議不當，可以附理由送請覆議；如果對覆議結果仍認為不當，也可以呈請市政府核辦。

A district office is to have one district chief and one deputy chief, both elected by the district representatives, and they serve for two years and may be re-elected.

區公所得置助理員及雇員。

本保公民組織的保設保民大會，負責審議、議決、選舉或罷免，以及聽取和詢問保辦公處工作事項。

保民大會開會時，由保長主持；保長有事故時，由副保長主持；如果兩者都有事故或與議題有利害關係，則由大會推舉一人主持。

保民大會原則上每兩個月開會一次，由保長召集；必要時也可召集臨時會議。

第三十二條及第三十三條的規定，適用於保民大會。

符合特定條件的人民聚居地方，可以設為市，並受省政府指揮監督。

This provision establishes a neighborhood office with one head and one deputy head, elected by the neighborhood residents’ assembly, and places it under the district chief’s supervision.

各戶戶長組織戶長會議；戶長因事故不能出席時，應派一人代表出席。

戶長會議有權選舉或罷免甲長，並處理本甲內應興革事項。

戶長會議由甲長召集，每月開會一次；必要時，也可由甲長或五戶以上請求召開臨時會議。

戶長會議在本甲戶長出席過半數時才可開會；議案表決則由主席決定。

甲長應執行戶長會議的決議案。

甲長在認為必要時，或在本甲居民十人以上連名請求時，應舉行甲居民會議。

When a district representative council or a bao people’s assembly has not been established, the city government appoints the district chief and deputy district chief, and the district office nominates double the number of candidates for the bao chief and deputy bao chief and submits them to the city government for appointment.

市政府負責訂定區民代表會及保民大會的議事規則。

The Executive Yuan has the power to prescribe the implementing rules for this law.

市的設置、廢止，以及市區域的劃定或變更，都要經國民政府核准。

This provision says the Act takes effect on the date of promulgation.

Districts are organized into baojia units, with jia, bao, and district groupings set at stated household counts; local adjustments need approval by a superior authority.

符合居住、年齡和登記條件的國民成為市公民，並可依法行使選舉、罷免、創制和複決的權利；有列舉情形者不得具公民資格。

市政府可以辦理市自治事項，並執行上級政府委辦事項。

市政府可以在不違反中央及上級政府法令的範圍內發布市令。
