縣組織法

County area is determined according to its existing area.

鄉鎮居民通常以25戶為閭、5戶為鄰；若因地勢或其他情形戶數不足，仍可依縣政府劃定成為閭鄰。

County government sets one county magistrate, appointed through nominations and provincial approval; the magistrate handles county affairs and supervises subordinate agencies and staff.

If a county preparing for self-government has reached the level set out in Article 8 of the National Program and is found qualified by the central authority, the county magistrate must be elected by popular vote.

縣政府要設秘書、科長與科員；科別和員額由省政府決定，並向內政部備案。

縣政府可以僱用事務員及僱員。

縣政府可以設置警察辦理催徵、送達、偵緝、調查等事項；其名額由民政廳核定。

County police matters may be handled by district public security sub-bureaus. Each sub-bureau has one chief, selected by the county magistrate from exam-qualified persons and submitted to the provincial government for approval and appointment.

縣政府所屬局長、分局長、科長、科員及其他佐治人員的任用資格、待遇與保障，另以法律規定。

省政府須將縣的廢置及縣區域變更事項，依序送內政部、行政院，並請國民政府核准後公布。

各省政府負責決定各縣政府所屬各局的組織與權限；如另有法令規定，則依該規定辦理，並向內政部備案。

縣政府應設置縣政會議，並由縣長、秘書及科長、各局局長組成；開會時由縣長擔任主席。

Certain county matters must be reviewed by the county government meeting, and the county magistrate may submit other matters for review when necessary.

縣政會議的會議規則由該會議自行議定。

縣政府辦事通則由內政部制定。

縣應設置縣參議會，由縣民選出的參議員組成；參議員任期三年，並且每年改選三分之一。

縣參議會有權議決縣預算決算、募債、縣單行規則，並可建議縣政興革事項及審議縣長交議事項。

The county council is established when the district chief is elected.

This provision establishes a district office, provides for one district chief, and assigns the district chief responsibility for district self-government affairs.

區民選任區長；縣政府並須將此事呈報民政廳備案。

縣政府在省政府指揮監督下，負責全縣行政並監督地方自治事務。

區民對區公約及自治事項有創制、複決的權利；在區長違法失職時，區民得罷免並改選。

區民在選舉區長時，還要選出5人或7人組成該區監察委員會；該委員會負責監察區財政，並向區民糾舉區長的違法失職。

本法施行一年後，省政府可依各縣情況決定區長民選實施時期，並須請內政部核准後辦理。

在區長民選實行以前，區長由民政廳自訓練考試合格人員中委任。

If a district chief appointed under the previous article acts unlawfully or neglects duty, the county magistrate may ask the provincial government to remove the district chief.

區公所得用助理員協助區長辦理政務；助理員由區公所遴請縣長委任。

區公所辦理區務時，可以設置區丁；區丁的額數由縣長決定。

區公所設區務會議，由區長主持並召集，且區務會議至少每月開會一次。

Certain listed matters must be reviewed by the district affairs meeting.

This provision says the matter is to be separately provided for by the District Self-Government Implementation Act.

省政府要按區域、事務、人口和財賦情況，將各縣縣政府分為三等，並依程序報請核准公布。

鄉公所、鎮公所各設一名鄉長或鎮長，鄉鎮並各設一名副鄉長或副鎮長；鄉鎮戶數在五百戶以上時，得再增設一名副鄉長或副鎮長。

鄉長或鎮長可以指定閭長協助辦理鄉公所或鎮公所事務。

鄉長、副鄉長、鎮長、副鎮長由鄉民大會或鎮民大會選任，並由區公所向縣政府備案。

If a township or town chief, deputy chief, or mayor/deputy mayor acts unlawfully or improperly, the township or town assembly may recall and re-elect them.

鄉民大會或鎮民大會在選舉鄉長或鎮長時，應選出三人或五人組成監察委員會；該委員會負責監督鄉鎮財政，並向鄉民或鎮民糾舉鄉長、副鄉長、鎮長或副鎮長的違法失職行為。

在區長民選實行前，鄉民大會或鎮民大會選舉鄉長、副鄉長或鎮長、副鎮長時，應選出加倍人數，並由區公所轉請縣長擇任，再由縣長向民政廳備案。

鄉民大會或鎮民大會在鄉長、副鄉長、鎮長、副鎮長違法失職時，應經區公所轉請縣長罷免；縣長也可以自行罷免。

The township autonomy implementation rules are provided separately.

Each 閭 has one 閭長 and each 鄰 has one 鄰長, and they handle local self-governance affairs.

閭長、鄰長由本閭鄰居民會議選舉產生；選定後，由鄉長或鎮長報區公所，並轉報縣政府備案。

縣政府在不牴觸中央及省法令的範圍內，可以發布縣令，也可以制定縣單行規則。

閭鄰居民會議有權對閭長、鄰長作罷免改選；鄉鎮公所認為其違法失職時，也可以通告閭鄰居民會議改選。

When village and neighborhood chiefs are dismissed or re-elected under the preceding article, the competent township office must report the matter through the district office to the county government for record.

閭長、鄰長的選舉方法和任期，另由鄉鎮自治施行法規定。

This provision says the Act’s commencement date will be set separately by order.

各縣應按戶口及地方情形劃分若干區；一般情況下，每區由十到五十個鄉鎮組成，但地方習慣、地勢限制或其他特殊情形可例外。

This provision classifies local areas as villages (鄉) or towns (鎮) based on household counts, with some exceptions.

縣政府要就區及鄉鎮區域的劃定或變更，向省政府請求核准；省政府並要向內政部備案。

區鄉鎮可以在不牴觸中央及省縣法令規則的範圍內，制定自治公約。
