墳墓設置管理條例

Tomb setup and management are governed by this ordinance; matters not covered by it follow other laws.

公墓內要按地形劃分墓區、在每區劃定墓基並編號；每一墓基面積不得超過16平方公尺，但兩棺以上合葬時，每棺可放寬10平方公尺。

Burial of a coffin in a cemetery must keep the coffin surface at least 70 cm below ground; if death was from an infectious disease, at least 120 cm below ground; and the grave mound may not be higher than 150 cm above ground. The grave must also be tightly sealed.

直轄市、縣（市）主管機關負責訂定公墓費用收取標準及方式。

直轄市、縣（市）主管機關應公告公墓的名稱、地點、所屬區域，以及設置者的名稱或姓名。

設置私人墳墓前，必須向當地主管機關報請核准，並依相關條文準備文件、選定地點；每一墓基面積不得超過第十條規定。

直轄市、縣（市）政府可以設置公墓管理機構；鄉（鎮、市）公所可以設置公墓管理員。

申請埋葬或火葬許可證的人，必須檢附兩份死亡證明書；當地主管機關要留存一份，並把另一份函送當地衛生主管機關備查。

A tomb, coffin, or body may not be exhumed without approval from the local competent authority.

公墓內的無主墳墓，管理機構或管理員在因更新或管理需要時，可先報經直轄市、縣（市）主管機關許可後，進行起掘、火葬或安置於骨堂（塔）內；起掘前原則上應提前三個月公告，必要時可縮短為一個月。

骨灰或骨骸安置在靈骨堂（塔）內的，可以減免收費；標準和方式由直轄市、縣（市）主管機關訂定。

This provision defines “tombs,” “public cemeteries,” and “private tombs.”

公墓可以依本條例更新；如因地形變更或其他特殊情形必須遷移，則應遷移，並先擬具更新或遷移計畫報請主管機關核准或備查。

公墓管理員應備簿冊，登記墓基編號、葬期、受葬者資料，以及營葬者或墓主資料與其關係。

公墓墳墓如有損壞，管理員應立即通知營葬者或墓主進行整修。

公墓管理員應於每年年底，將公墓管理情形報請鄉(鎮、市、區)公所轉報主管機關查核。

If a local authority finds a grave site interferes with certain public interests, it must be relocated; government-designated famous ancient graves are exempt.

當地主管機關在遷葬前3個月要公告、書面通知營葬者或墓主，並在墓棺前設標誌；逾期未遷時，主管機關要代為遷葬，設有火葬場者並得火葬。

If a grave is set up in violation of this rule, the local authority must stop it. Buried graves must be moved within three months unless repair procedures are ordered. If not moved on time, a fine of NT$3,000 to NT$10,000 applies.

意圖營利、違反第六條規定而擅自設置公墓者，會被處三年以下有期徒刑，並得併科十萬元以下罰金。

經催告限期繳納後仍逾期未繳納的本條例罰鍰，由主管機關移送法院強制執行。

設置殯儀館、火葬場、靈(納)骨堂(塔)及其他喪葬設施，須先經直轄市、縣(市)主管機關核准；其管理規定也由該主管機關訂定。

This provision defines which authority counts as the competent authority at different levels of local government.

Private or group-owned cemeteries established before this provision took effect must apply under this Act within one year.

本條例的施行細則由內政部訂定。

This provision says the regulation takes effect on the date it is promulgated.

直轄市、縣（市）政府及鄉（鎮、市）公所應在轄區內或外選擇適當地點，依本條例設置公立公墓。

私人或團體可以設置私立公墓。

設置公墓時，申請人要備齊指定文件，報請直轄市、縣（市）主管機關核准；如果是由直轄市、縣（市）主管機關自行設置，則要報請中央主管機關備查。

設置或擴充公墓時，應選擇不影響水土保持、景觀、耕作與公共利益的適當地點，並遵守與特定地點的距離限制。

The land set aside for cemeteries under Article 4 and the land for their external access roads may be expropriated under the Land Act.

公墓應設置必要設施，並種植花木、美化環境。
